Excerpt from The Present Law and Practice Relating to Letters Patent for Inventions The English Law of Letters Patent is of the greatest interest both from the legal and the commercial point of view. It was the forerunner and the model of the Patent Laws of all countries; in the past it has greatly helped to build up the commercial supremacy of this Country, and on the certainty and justness of this law and its administration depends to-day the Willingness of capital to assist in developing new inventions. But the subject is one whose treatment presents great difficulties to the author, since the majority of the reported decisions really turn on questions of fact. The Courts have quite properly realised this and the practice of quoting numerous authorities on such questions as subject-matter and infringement has greatly decreased. Nevertheless the citation of a really apposite decision is often of the greatest value, and the just appreciation of prior decisions is also of great assistance to those who have to advise on questions relating to Letters Patent. I have therefore attempted to give in a digested and classified form the decisive points in all such cases as may be likely to be of assistance for either of these purposes. Excerpt from The Law and Practice: Relating to Letters Patent for Inventions, With an Appendix of Statutes, Rules, and Official Forms The object of this book is to present in as concise a form as possible the whole of the law relating to letters patent for inventions, and such matters of practice as relate particularly to patent grants. The author believes that the text refers to all the reported cases which are now of any importance. It contains no reference to matters and cases which are of historical interest only. As the decisions concerning grants of compulsory licences under section 22 of the Patents Act, 1883 - now repealed - will, it is conceived, be of little or no value, as authorities, under the Act of 1902, they are not here referred to. Although the author has spared no pains to prevent defects and errors, he does not venture to think that the book is altogether free from these. Whatever its shortcomings, he hopes that the treatise may be found useful by members of the legal profession and others interested in the subject-matter. Excerpt from The Law and Practice Relating to Letters Patent for Inventions: With Appendix, Containing the Patents, Design and Trade Marks Act, 1883 Patent, Trade Marks, Designs and Privy Council Rules When the Act of 1883 was passed, some totally new provisions were adopted, and it was enacted by sect. 5, sub-sect. 2, that in every case the applicant must declare tfiut lie is the first and true inventor of an invention. This may have been an oversight, or it may have been intentional. I am rather inclined to think it was designed to abolish imported inventions; because we find only one form of declaration provided in the Act, which will clearly not do for an imported invention. Sect. 46 defines the word invention as meaning any manner of new manufacture within sect. 6 of the Statute of Monopolies. As soon as the Act was passed, a great deal of discussion arose as to whether or not communi cated inventions were abolished by sect. 5. The opinion seemed to prevail that this form of patent could not thenceforth be granted, and that the definition of the word invention did not empower a man in possession of a communicated invention to make a declaration (equiva lent to an affidavit) that he was the true and first inventor. Of course, patent agents, who were vitally interested, strongly objected to the change which was supposed to have been made in the law; and Mr. Chamberlain, I imagine, must have yielded to their representations, forviii preface.
