The Endangered Species Act of 1973 (ESA) is one of the most cherished and reviled laws ever passed. The history of the ESA has been one of increasing impact, complexity, and controversy. In 1978, the Supreme Court declared that Congress intended for the U.S. government to save all species at any cost, and thereafter application of the ESA became steadily more controversial, as seen in the example of the northern spotted owl and the timber wars in the Pacific Northwest in the late 1980s and early 90s, and then everywhere as the ESA became a political football in the highly partisan environment of the late 1990s and amendments to the law ceased. Protecting endangered species of animals and plants is a goal that almost everyone supports in principle--but in practice private landowners have often opposed the regulations of the Endangered Species Act, which, they argue, unfairly limits their right to profit from their property. To encourage private landowners to cooperate voluntarily in species conservation and to mitigate the economic burden of doing so, the government and nonprofit land trusts have created a number of incentive programs, including conservation easements, leases, habitat banking, habitat conservation planning, safe harbors, candidate conservation agreements, and the "no surprise" policy. Animal Property Rights: A Theory of Habitat Rights for Wild Animals represents the first attempt to extend liberal property rights theory across the species barrier to animals. It broadens the traditional focus of animal rights beyond basic rights to life and bodily integrity to rights to the natural areas in which animal reside. John Hadley argues that both proponents of animal rights and environmentalists ought to support animal property rights because protecting habitat promotes ecological values and helps to ensure animals live free from human interference. Hadley’s focus is pragmatist – he locates animal property rights within the institution of property as it exists today in liberal democracies. He argues that attempts to justify animal property rights on labor and first occupancy grounds will likely fail; instead, he grounds animal property rights upon the importance of habitat for the satisfaction of animals’ basic needs. The potential of animal property rights as a way of reinvigorating existing public policy responses to the problem of biodiversity loss due to habitat destruction is thoroughly explored. Using the concept of guardianship for cognitively impaired human beings, Hadley translates habitat rights as a right to negotiate – human guardians ought to be allowed to negotiate, on behalf of wild animals, with human landholders whose development activities put animals at risk.
