The objective of this evaluation is to provide the European Commission with an independent and evidence-based evaluation of Regulation (EU) No 996/2010 on the investigation and prevention of accidents and incidents in civil aviation. The evaluation assesses whether the main objectives of the regulation have been achieved since its entry into force in December of 2010. This evaluation stems from the Better Regulation initiative in which President Juncker has committed the current Commission to improving the quality of EU policy- and law-making, in order to ensure that legislation better serves the people it affects. This resulted in a stronger emphasis on ex-post evaluation in the policy cycle.

Independent investigation of accidents/incidents and occurrence reporting is essential in the drive to improve aviation safety. This study will assist the European Parliament in reviewing current EU policy for greater efficiency in civil aviation accident investigation. This is being addressed under a proposal for a new regulation which is an essential element of this study in assessing the existing problems and shortcomings in the investigation and prevention of accidents and incidents in civil aviation. Accident investigation and occurrence reporting in EU aviation are currently regulated separately under EC law. A concise overview of the current European legal framework of accident/incident investigation in EU aviation, in the context of Directive 94/56/EC, has been provided. The legal framework has been contrasted with its practical implementation within EU aviation. Beyond accident investigation, the crucial element of occurrence reporting has also been analysed and assessed against its legal provisions within Directive 2003/42/EC.

The events of 11 September 2001 have so deeply shaped aviation history that everything else seems now to be of little importance. And yet the airline crisis had started already before that fatal date, As had the low-cost airlines. Even the collapse of Swissair and, Of course, Of Sabena had older histories and were not caused but only accelerated by the September terrorist attacks. the year 2001 has continued to see the trend to alliances and consolidation between airlines, but also, importantly, indications of the EC Commission¿s emerging policy in this area. Airports have also continued to receive increasing regulatory attention, particularly with regard to relations between airports and neighbouring communities in the face of the increasing demand for capacity at airports. The practical operation of Council Directive 94/56 on aircraft accident investigation has been tested by experience, particularly following the Concorde accident.
