This book addresses the discursive importance of the prosecution’s opening statement before an international criminal tribunal. Opening statements are considered to be largely irrelevant to the official legal proceedings but are simultaneously deployed to frame important historical events. They are widely cited in international media as well as academic texts; yet have been ignored by legal scholars as objects of study in their own right. This book aims to remedy this neglect, by analysing the narrative that is articulated in the opening statements of different prosecutors at different tribunals in different times. It takes an interdisciplinary approach and looks at the meaning of the opening narrative beyond its function in the legal process in a strict sense, discussing the ways in which the trial is situated in time and space and how it portrays the main characters. It shows how perpetrators and victims, places and histories, are juridified in a narrative that, whilst purporting to legitimise the trial, the tribunal and international criminal law itself, is beset with tensions and contradictions. Providing an original perspective on the operation of international criminal law, this book will be of considerable interest to those working in this area, as well as those with relevant interests in International/Transnational Law more generally, Critical Legal Studies, Law and Literature, Socio-Legal Studies, Law and Geography and International Relations.

From the best-selling author of The Defense, a spellbinding sequel: The Prosecution. It was a one-way ticket out of his self-imposed isolation and into the courtroom on the right side of justice. It was a favor for his old friend Judge Horace Woolner. It was a once-in-a-lifetime chance to serve as special prosecutor in a case against a man sworn to uphold the law, Marshall Goodwin, the chief deputy district attorney accused of having his former wife murdered. It was an opportunity Joseph Antonelli couldn't walk away from. But Antonelli is walking into more than he bargained for. The Goodwin case renews his appetite for the practice of law, and although Antonelli is determined to remain on the side of justice, there are many shades between right and wrong. And Antonelli may be over his head when Russell Gray, an urbane, worldly, and wealthy man from a prominent Portland family, is found murdered in his living room. Horace Woolner's wife stands accused of the crime. With justice and love on the line, the stakes couldn't be higher. In this stunning look at our legal system and our hearts, D. W. Buffa delivers on the promise of The Defense and takes us into the dark recesses of our courtrooms and our souls, where there are no easy answers.

However, when questioned, Romaine informs the police that Vole returned home late that night covered in blood. The vast majority of prosecution work occurs outside of courtrooms and less than 10% of all criminal cases go to trial. Courtroom performance, then, is of little import if prosecutors have not carefully investigated and prepared cases for prosecution. Courtroom performance is at its best, on the other hand, when prosecutors have thoroughly supervised the investigation and prepared the case for trial. In the end, the raw material prosecutors have to work with in courtrooms—the evidence—is a product of all of the work prosecutors perform outside the courtroom. For the Prosecution: How to Prosecute Criminal Cases seeks to provide prosecutors and those who wish to become prosecutors, including law students, guidance on how to prosecute criminal cases from investigation to appeal. This book provides guidance on how to successfully investigate and prosecute criminal cases. Thus, this book focuses on strategies and tactics involved in prosecution, and the soft skills for managing cases and people. This book examines how to think about criminal cases, guide investigations, and break down and organize complex cases in a persuasive manner. The book also examines ways to organize and prioritize caseloads, strategies for taking down criminal organizations, and tactics for turning criminals into cooperators. The book describes how to handle motions practice, prepare a case for trial, and successfully litigate sentencing hearings and appeals. This is not just another trial advocacy book. It is all of the work prosecutors perform outside the courtroom that makes it possible for them to resolve more than 90% of their cases through guilty pleas, and to prevail on the relatively few cases that go to trial. This book focuses on all the laws, duties, strategies and tactics prosecutors execute investigating and prosecuting criminal cases for those who wish to become prosecutors or further their career. Throughout C.J. Williams explores the strategies and tactics involved in prosecuting criminal cases, as well as examines the skills a successful prosecutor needs to develop in order to work with all those involved in the criminal justice system. He even brings his own experiences and lessons learned about prosecuting criminal cases into For the Prosecution, giving the reader more than the typical trial advocacy book.

The American prosecutor plays a powerful role in the judicial system, wielding the authority to accept or decline a case, choose which crimes to allege, and decide the number of counts to charge. These choices, among others, are often made with little supervision or institutional oversight. This prosecutorial discretion has prompted scholars to look to the role of prosecutors in Europe for insight on how to reform the American system of justice. In The Prosecutor in Transnational Perspective, Erik Luna and Marianne Wade, through the works of their contributors coupled with their own analysis, demonstrate that valuable lessons can be learned from a transnational examination of prosecutorial authority. They examine both parallels and distinctions in the processes available to and decisions made by prosecutors in the United States and Europe. Ultimately, they demonstrate how the enhanced role of the prosecutor represents a crossroads for criminal justice with weighty legal and socio-economic consequences.

First published in 1925, 'The Witness for the Prosecution' is a short story and play by Agatha Christie, an English writer best known for her 66 detective novels and 14 short story collections, specifically those revolving around fictional detectives Hercule Poirot and Miss Marple. When affluent spinster, Emily French is found murdered, skepticism falls on Leonard Vole, the man to whom she impatiently bequeathed her riches before she died. Leonard assures the investigators that his wife, Romaine Heiliger, can provide them with an alibi. However, when questioned, Romaine notifies the police that Vole returned home late that night covered in blood. During the trial, Ms. French's housekeeper, Janet, gives damning proof against Vole, and, as Romaine's cross-examination begins, her motives come under scrutiny from the courtroom. The packed courtroom waited as Romaine mounted the stand to deliver the testimony that has made this the masterpiece of suspense and shock. The ultimate question is whether justice will prevail or not.
