Despite its prominence in public discourse, the notion of elites remains a highly contested and ambiguous part of modern political discourse. This monograph rehabilitates the idea of elites and gives it a solid theoretical footing, while relating it with the historical development of liberal thought in the west. The analysis offered in the book concentrates on the tradition of liberal political thought in France, which has consistently tackled the question of the elites, their role in society, and the process of their formation. Combining theoretical insights with practical wisdom, French liberal thinkers have seen the elite as an indispensable social category and as a vehicle for the development of human liberty. In their different prescriptive doctrines, French liberal thinkers have sought to reconcile the emergence of social elites with the requirements of social and political equality, as well as with the ongoing modernization of mores and institutions. After defining elitism and tracing its uneasy relation to modernity, the author discusses Nietzsche's, George's, and Hesse's cultural elites within both the context of their work and the course of European history. Their mature elitism is seen as being central to hopes for saving a decadent Europe from total collapse. The root of their discontent is found in a fear of modernity that pushed all three into the camp of radical conservatism. Combined with this outlook on society, their elitist idealism encouraged a state of mind that indirectly facilitated the rise of National Socialism, and hence the kind of cultural corruption Nietzsche, George and Hesse opposed - a contradictory result through which the author sheds light on the nihilistic undertones of modern elitism.

Can in fact everyone belong to an elite? To answer this question the author would like to present and critically examine three elite theories that differ in content and time. He is not only concerned with access to the elites, i.e. how they recruit themselves, but in the overall context with how a group of influential and powerful people emerges and how they maintain themselves. His argument is that he believes that access to an elite can be understood much better by examining how they emerge and try to maintain their position in society. The question of social access to the elites, therefore, is always a question of how they emerged and how they are maintained. But the main focus will ultimately be on the question of the access of individuals to elites. In this work he will therefore identify the social factors that determine the emergence of, the access to and the maintenance of elites. Everyone has heard the term “elite” before. But very few know what it means or who exactly it refers to. Defined by the Cambridge Dictionary, the "elite" are "those people or organizations that are considered the best or most powerful compared to others of a similar type". But what makes them "the best" or "most powerful"and how do they get into this privileged position? In our democratic society, it is assumed that education, performance and success are decisive for advancing one to an elite position. Allegedly, anyone can ascend to a privileged elite position. Open access to the elites is one of the central norms of a representative democracy. The author will therefore start with a small historical and theoretical background to the term "elites"itself, since it is often unclear what is meant by elites. Indeed, the term can be used in different ways and with different meanings, as we will see. This is followed by Mosca’s classical elite theory. Unfortunately, due to the limited scope of the work, he has to cut back on the classics of elite theories. Premised on the Hobbesian conceptualization of law as the command of the sovereign, this paper traces the resilience of this conceptualization through to the modern democratic states. It looks at the change of the sovereign from an individual to an office and now the diffusion of power through different systems of checks and balances instituted by the modern political system of democracy. In doing this, the paper answers the question; to what extent is law the reflection of the wishes of political elites in a society? It explores the sources of law and the role of law as an organizing agent with a view of exposing the resilience of the political elite’s interests in law and in the use of law. The paper finally concludes that despite the changing nature of political systems, political elites have been able to preserve the law as a tool at their service. They have used their law making power to express their wishes in the law as well as used the complex procedural nature of law with several actors involved to serve their interest.
