His book is an analysis of the motive powers of the Government of this country, none the less searching and profound because written in a familiar style. In a Preface to the second edition, which came out in 1872, he admits that much had changed in the previous seven years; that the disappearance of Palmerston, Derby, and Russell, the statesmen of the days before the first Reform Bill, made a marked difference in the atmosphere of politics, independent of any legislative change, and that the extension of the franchise in 1867 had altered, and would probably alter still further, the character of the electorate. But he reprinted his book as it was written, subject to reservations in the Preface; and useful as it may be to compare the Bagehot of 1872 with the Bagehot of 1868, it is more important to compare these with the work of Mr. Low writing in 1904. Excerpt from The Custom of Paris in the New World It will be noted that, by the terms of the decree of 1664, the courts of the colony were to be guided not only by the provisions of the Custom of Paris but by the laws and ordinances of the realm. The ordinances of the French crown prior to this date had been numerous; but very few of them had made any important changes in the law of private relations. The age of Louis XIV, however, proved to be prolific in legislation of this sort, and a succession of ordinances commencing in 1667 and commonly known as the ”grandes ordon nances revised and codified several important branches of the law This legislation, in the main, supplemented the Custom of Paris, and covered fields of law into which the terms of the Custom had not ventured; but to some extent the ordinances varied and altered in effect the provisions of this latter code It therefore becomes im portant to know whether these grandes ordonnances: applied to France alone, or whether their provisions extended to the colonies as well. In France it was necessary, before an ordinance of this sort should become valid, that it should be registered by the Parliament of Paris. Excerpt from The Law of Usages and Customs: A Practical Law Tract That according to the practice of this right no person can get into the occupation of a farm without paying the previous occupier the price of his right of occupation or good-will, whether the land he held by lease or at will. That on the ejectment of any occupying tenant he reserves the full selling value of his tenant-right, less by any arrears due to the landlord. That the same custom, nu recognized as it is by law, prevents the lord who has bought the tenant-right, or otherwise got into possession of a farm, from setting it at such an increase of rent as to displace tenantsright. Thus, middle men are almost un known, and the effect of competition for land is principally to increase the value of the tenant-right, not the amount of the rent. That tenant-right exists even in nu improved land, and that five years' purchase is an ordinary payment for the tenant-right of such land, while fifteen or twenty years' purchase is often given for the tenant-right of highly improved farms.
