Death is not what it used to be. With the rise of social media and advances in digital technology, postmortem decision-making increasingly involves difficult questions about the ongoing social presence of the deceased. Should a Twitter account keep tweeting? Should a YouTube singer keep singing? Should Tinder photos be swiped left for the very last time? The traditional touchstones of effective estate planning -- reducing transaction costs and maximizing estate value -- do little to guide this new social afterlife. Managing a person's legacy has shifted away from questions of financial investment and asset management to questions of emotional and cultural stewardship. This Article brings together the diverse areas of law that shape a person's legacy and develops a new framework for addressing the evolving challenges of legacy stewardshipThis Article makes two main contributions. First, it identifies and critically examines the four models of stewardship that currently structure the laws of legacy: (1) the “freedom of disposition” model dominant in the laws of wills and trusts, (2) the “family inheritance” model dominant in copyright law, (3) the “public domain” model dominant in many states' publicity rights laws, and (4) the “consumer contract” model dominant in over forty states' new digital assets laws. Second, this Article develops a new stewardship model, which it calls the “decentered decedent.” The decentered decedent model recognizes that individuals occupy heterogenous social contexts, and it channels postmortem decision-making into each of those contexts. Unlike existing stewardship models, this new model does not try to centralize stewardship decisions in any one stakeholder -- the family, the public, the market, or even the decedent themselves. Instead, the decentered decedent model distributes stewardship across the diverse, dispersed communities that we all leave behind.

This book explores how social networking platforms such as Facebook, Twitter, and WhatsApp ‘accidentally’ enable and nurture the creation of digital afterlives, and, importantly, the effect this digital inheritance has on the bereaved. Debra J. Bassett offers a holistic exploration of this phenomenon and presents qualitative data from three groups of participants: service providers, digital creators, and digital inheritors. For the bereaved, loss of data, lack of control, or digital obsolescence can lead to a second loss, and this book introduces the theory of ‘the fear of second loss’. Bassett argues that digital afterlives challenge and disrupt existing grief theories, suggesting how these theories might be expanded to accommodate digital inheritance. This interdisciplinary book will be of interest to sociologists, cyber psychologists, philosophers, death scholars, and grief counsellors. But Bassett’s book can also be seen as a canary in the coal mine for the ‘intentional’ Digital Afterlife Industry (DAI) and their race to monetise the dead. This book provides an understanding of the profound effects uncontrollable timed posthumous messages and the creation of thanabots could have on the bereaved, and Bassett’s conception of a Digital Do Not Reanimate (DDNR) order and a voluntary code of conduct could provide a useful addition to the DAI. Even in the digital societies of the West, we are far from immortal, but perhaps the question we really need to ask is: who wants to live forever?

How does an inquiry into life as it lives (or dies) amid mass violence look like from the perspective of the “social”? Taking us from Sierra Leone to India to Lebanon, Life, Emergent challenges conventional understandings of biopolitics, weaving a politics of life through the lens of life, not death. Arguing that the “letting die” element of biopolitics has been overemphasized, Yasmeen Arif zeros in on biopolitics’ other pole: “making live.” She does so by highlighting the various means and the forms of life configured in the aftermath—or afterlives—of violent events in contexts of law, justice, community, and identity. Her analysis of the social repercussions is both global and local in scope. Arif examines the convictions made in the Special Court of Sierra Leone, the first hybrid court of its nature under international criminal law. Next, she explores the making of a justice movement in the context of Hindu–Muslim violence in 2002 in the state of Gujarat, India. From there she revisits the Sikh carnage in Delhi of 1984. Finally, she explores a span of civil violence in Lebanon, and particularly, its effects on the city of Beirut. This rigorously argued book brings together the various strands of life and the social that each chapter has disentangled—and in doing so it begins to frame a politics of, and in, life.

Why is belief in an afterlife so persistent across times and cultures? And how can it coexist with disbelief in an afterlife? Most modern thinkers hold that afterlife belief serves such important psychological and social purposes as consoling survivors, enforcing morality, dispensing justice, or giving life meaning. Yet the earliest, and some more recent, afterlives strikingly fail to satisfy those needs. In Inventing Afterlives, Regina M. Janes proposes a new theory of the origins of the hereafter rooted in the question that a dead body raises: where has the life gone? Humans then and now, in communities and as individuals, ponder what they would want or experience were they in that body. From this endlessly recurring situation, afterlife narratives develop in all their complexity, variety, and ingenuity. Exploring afterlives from Egypt to Sumer, among Jews, Greeks, and Romans, to Christianity’s advent and Islam’s rise, Janes reveals how little concern ancient afterlives had with morality. Where are the dead? What are they doing? What kind of a process is dying? What relationships exist among the dead themselves, and between the dead and those in the world they have left behind? Modern philosophers argue that the idea of disembodied survival - to which many believers pay lip service - is incoherent, and that there can be evidence neither for nor against something incoherent.
