Indigenous rights in Australia are at a crossroads. Over the past decade, neo-liberal governments have reasserted their claim to land in Australia, and refuse to either negotiate with the Indigenous owners or to make amends for the damage done by dispossession. Many Indigenous communities are in a parlous state, under threat both physically and culturally. In Sovereign Subjects some of Indigenous Australia's emerging and well-known critical thinkers examine the implications for Indigenous people of continuing to live in a state founded on invasion. They show how for Indigenous people, self-determination, welfare dependency, representation, cultural maintenance, history writing, reconciliation, land ownership and justice are all inextricably linked to the original act of dispossession by white settlers and the ongoing loss of sovereignty. From the INTRODUCTORY. IN the various systems of philosophical theories of government, which have been given to the world since the human reason was emancipated by the revival of learning, sovereignty, with scarcely an exception, has held a prominent place, and upon their conception of it all of the foremost thinkers since that time have rested their philosophic systems. The two great exceptions to this general practice are Montesquieu and Locke. The former neither defines nor treats of sovereignty; and the latter fails even to mention the word. The explanation of this apparently vital omission from their systems may be found in the ethical idealism of these philosophers, who exalted moral obligation to an actual force and gave to man's consciousness of right a determinate authority which is denied by historical experience. They dealt with what they conceived ought to be in human affairs, rather than what really is. The other political philosophers preceding Locke, and Montesquieu such men as Jean Bodin, Suarez, Johannes Althusius, Hobbes and Spinoza, while often intermingling abstract right with strict legality, saw the necessity of recognizing sovereignty as an ever present factor in all phenomena of government, and, therefore, of introducing it into their systems. When Hume by the force of his logic discredited the "contract" theory of the source of governmental power which had swayed philosophic thought for a century and set in motion those doctrines that found fuller expression in the writings of Bentham and Austin, sovereignty again assumed the importance which it had in a measure lost through the influence of Locke and Montesquieu. To modern writers upon political philosophy, jurisprudence and law the subject of sovereignty has been one of recognized importance. Indeed, it has been to the great body of philosophic thought for the past three hundred years the persistent force which affects all the political relations of mankind. To the present-day philosopher, it is even more; it is the fundamental authority which controls, restrains and protects man as a member of society. In the advanced state of modern thought, it is irrational to consider origins or to trace the development of political institutions without admitting the existence and constant activity of sovereignty, and its potency in the creation, evolution, and expansion of such institutions. No problem of government can be proposed in which it is not an essential factor. No explanation of such terms as liberty and law satisfies the reason or appeals to man's consciousness of truth which does not introduce, define, and apply sovereignty.

The book deeply analyses the bilateral relations between Switzerland and the European Union and their effect on the former's sovereignty in the context of Europeanisation. This touches on philosophical debates on the complexity of sovereignty. What sovereignty is at stake when talking about Swiss-EU relations? This issue not only faces the elusiveness of sovereignty as a concept, but also the proliferation of hypocrisy on its presence within states. The book encounters the deconstructionist hypothesis stating that there is nothing to worry about but the belief there is something to worry about. Derrida’s deconstruction of sovereignty allows indeed one to grasp the fictional essence of sovereignty based on the metaphysics of presence. The presence of self-positing sovereign ipseity is fictional since absent in the present, but spectrally present in the belief of its presence to come. Sovereignty is a matter of credibility, or the credible promise of a normative statement to come. Hence, the book challenges the realist/neorealist argument stating that states are credibly sovereign until proven otherwise and explains that the debate on state sovereignty calls for the unveiling of this hypocritical epistemology cunningly disguised as an objective presence. Swiss-EU relations thus become the cornerstone to not only theorise but also test sovereignty and deconstruct the two ontological and epistemological sides of the same coin, or the modern hypocrisy of sovereignty. This deconstruction constitutes the very problématique of any attempt to understand whether and how a state can be sovereign and solve the problem as to how to neutralise the différance and identify the difference between credible and incredible claims of sovereignty. This problématique connects the theory and practice of sovereignty innovatively, providing positivist evidence on the arguable credibility of the Swiss claim of sovereignty and confirming the presence of a theological dimension within politics.

The answer this dissertation offers and defends is one that sees war as constituted by a relay of social forces that reflects the privileging of particular subjects in the international system. War is defined through a relationship between this particular use of force and the dominant actor in international politics--the state. As such, war is a representation of sovereign authority. The dominant understanding of war is produced via a performative relationship between sovereignty and war whereby neither has an actual essential meaning, but the interaction of the two privileges a set of political practices that creates a particular representation and maintains it. In some ways war is created by the state, but the particular understanding of war as territorial, prosecuted by states, and temporally bound, is both created through the state, but equally it helps to maintain the sovereign state system itself.
