Excerpt from The Teaching of English Law at Harvard Can English law be taught at the Universities? This question was, some sixteen years ago, raised in my inaugural lecture at Oxford. The answer then given, on theoretical grounds, was that English law could be effectively taught at the Universities by duly qualified teachers to duly intelligent students. It is now in my power to assert with confidence that my speculative conclusion is proved to be correct by the irrefutable results of American experience. Wherever the law of England prevails throughout the American continent the best instructed and the ablest lawyers have been grounded in its principles by professors. The schools of New York, of Chicago, of Ontario, of Nova Scotia, of Boston, and, above all, of Harvard, establish the fact, or (as our lawyers of the older school might put it) give plausibility to the paradox that English law can be taught at Universities, and be taught by University professors. On the other side the Atlantic, indeed, the truth of this conclusion is treated as established past dispute. It will further be admitted by every competent judge that nowhere throughout America is law taught so thoroughly as at the University of Harvard. Excerpt from An Elementary Commentary on English Law: Designed for Use in Schools I have written a good deal in past years for the members of my own profession for men trained in the science of law, but have long felt a desire to write something for the young; something which may enable the rising generation to acquire a knowledge of the rudiments of the laws of their own country - laws by which we are all governed, and which we all have to obey. Although this small commentary on English law has been composed chiefly in the interest of boys, it is hoped that, in these times of quickly advancing education, it may be found to be not inappropriate for girls also. The utility of, indeed the necessity for, some knowledge of law in the young has been dealt with fully in the first chapter of the book. I have usually given no authorities for my various statements and propositions. The authorities for the same are contained in many ponderous books, to which a reader of this work would have no access. That such a book as this is necessarily imperfect I shall be the first to acknowledge. A complete acquaintance with any of the subjects, to which only a page or two are here devoted, would necessitate the reading of many volumes known to and studied by lawyers. All general principles of law ramify into sub-principles, and are subject to exceptions, to most of which it has only been possible to allude in the most cursory way. The only parts of the book which it is feared may be found difficult, either to master or pupil, are the chapters relating to land. The land law of England, which has been in the course of development for many centuries, and which exemplifies perhaps better than any other part of the law the English character and traditions, is necessarily abstruse, and certainly not easy to condense. The introduction to the first lecture shows the circumstances under which the lectures were given, and the scope and purpose of the course. I have, however, added some notes in the line of further development or illustration. It might have been more artistic to have recast the whole, working the notes into the text; but if this had been done, the loss would have exceeded the gain, since the lectures thus remodelled would not have been the lectures delivered, and they would moreover have contained details not adapted to oral discourses. Besides, it is a prized privilege of the teacher to make use of the first person, as this enables him to address his hearers more directly and more forcibly than in any other way.
