Excerpt from The Terry-Broderick Duel It is now more than thirty years since the world-renowned duel between David S. Terry and David C.Broderick transpired, in which the latter fell mortally wounded. Be fore proceeding with a detailed account of this terrible tragedy and the immediate circumstances and causes which led up to it, it is proper to notice the condition of society in California in the earlier days and the political state of affairs during the first decade of the state's history. During the year 1849, and for a few years thereafter, there was a large immigration to California from nearly all the states of the Union. They were mostly young men under forty years of age, who came seeking fortunes in this new and promising land. Many were ambitious for political distinction and regarded California as a promising field for political enterprise. Of the latter class, the southern states furnished the larger proportion, and they came fully impressed with the belief that they were the superiors of the northern men in the qualities of gentlemen born to rule, and therefore the party leaders and directors of political affairs were to be found mainly in the ranks of these southern gentlemen, some of whom before coming to California had held public positions of honor. They believed in slavery as a beneficent institution, and for the most part regarded the "Code of Honor" as an appropriate means for the settlement of personal grievances. Excerpt: A duel is an arranged engagement in combat between two individuals, with matched weapons in accordance with agreed-upon rules. Duels in this form were chiefly practiced in Early Modern Europe, with precedents in the medieval code of chivalry, and continued into the modern period (19th to early 20th centuries) especially among military officers. During the 17th and 18th centuries (and earlier), duels were mostly fought with swords (the rapier, later the smallsword, and finally the French foil), but beginning in the late 18th century and during the 19th century, duels were more commonly fought using pistols, but fencing and pistol duels continued to co-exist throughout the 19th century. The code of the honourable duel surrounded the notion of honour. Duels were fought not so much to kill the opponent as to gain "satisfaction," that is, to restore one's honour by demonstrating a willingness to risk one's life for it, and as such the tradition of duelling was reserved to the male members of nobility, in the modern era extendend to those of the upper classes more generally. From the early 17th century duels were often illegal in Europe, though in most societies where duelling was socially accepted, participants in a fair duel were not prosecuted, or if they were, not convicted. Excerpt from Grizzly Bear, Vol. 50: November, 1931 In 1857 Broderick was elected United States Senator from California for a full term. Gwin was re-elected with Broderick's support, but for an unexpired term. In 1858 an attempt was made to carry the state for the Lecompton standard. Broderick toured the state. Making speeches everywhere in opposition to the exten sion of slavery. As the campaign became more intense and more and more bitter, Broderick thought it necessary to unmask the true char acter of Senator Gwin. To do this, he made pub lic the scarlet letter, a communication which Gwin had written to Broderick, implying that if Broderick would support his re-election he would not exercise his right to dictate patronage appointments to the president. Broderick sup ported Gwin's re-election, but Gwin immediately broke his promise. In Washington, Gwin turned the favor of President Buchanan away from Broderick, and as a result Broderick became a strong opponent of the presidential administra tion. So strong was his opposition in the Senate to the extension of slavery that Southern leaders became most hostile to him. As a result of this violent opposition to the powers that were, the leaders of the Lecompton group in California marked Broderick as a man to be gotten rid of. Senator Gwin and his friends, who were both ashamed and indignant over the expose of the scarlet letter, also acquiesced in this. To the honor of these old Californians, it must be said that no attempt was made to murder Broderick. They at least gave him an open chance to defend his life. David C. Terry, a justice of the Supreme Court. Challenged Broderick to a duel. After months of letter writing the date was set for September 12, 1859. Terry predicated his challenge upon grounds of certain derogatory remarks about him made by Broderick, but it was an open secret that Terry was really the avenger of his friend.
