After the Constitutional Convention, Benjamin Franklin was asked, “Well, Doctor, what have we got—a Republic or a Monarchy?” Franklin’s response: “A Republic—if you can keep it.” This book argues: we couldn’t keep it. A true republic privileges the common interest above the special interests. To do this, our Constitution established an elaborate system of checks and balances that disperses power among the branches of government, which it places in conflict with one another. The Framers believed that this would keep grasping, covetous factions from acquiring enough power to dominate government. Instead, only the people would rule. Proper institutional design is essential to this system. Each branch must manage responsibly the powers it is granted, as well as rebuke the other branches when they go astray. This is where subsequent generations have run into trouble: we have overloaded our government with more power than it can handle. The Constitution’s checks and balances have broken down because the institutions created in 1787 cannot exercise responsibly the powers of our sprawling, immense twenty-first-century government. The result is the triumph of special interests over the common interest. James Madison called this factionalism. We know it as political corruption. Corruption today is so widespread that our government is not really a republic, but rather a special interest democracy. Everybody may participate, yes, but the contours of public policy depend not so much on the common good, as on the push-and-pull of the various interest groups encamped in Washington, DC.

A look at the role of state policies in North-South economic divergence and in American industrial development leading up to the Civil War. In 1796, famed engineer and architect Benjamin Henry Latrobe toured the coal fields outside Richmond, Virginia, declaring enthusiastically, “Such a mine of Wealth exists, I believe, nowhere else!” With its abundant and accessible deposits, growing industries, and network of rivers and ports, Virginia stood poised to serve as the center of the young nation’s coal trade. By the middle of the nineteenth century, however, Virginia’s leadership in the American coal industry had completely unraveled while Pennsylvania, at first slow to exploit its vast reserves of anthracite and bituminous coal, had become the country’s leading producer. Sean Patrick Adams compares the political economies of coal in Virginia and Pennsylvania from the late eighteenth century through the Civil War, examining the divergent paths these two states took in developing their ample coal reserves during a critical period of American industrialization. In both cases, Adams finds, state economic policies played a major role. Virginia’s failure to exploit the rich coal fields in the western part of the state can be traced to the legislature’s overriding concern to protect and promote the interests of the agrarian, slaveholding elite of eastern Virginia. Pennsylvania’s more factious legislature enthusiastically embraced a policy of economic growth that resulted in the construction of an extensive transportation network, a statewide geological survey, and support for private investment in its coal fields. Using coal as a barometer of economic change, Old Dominion, Industrial Commonwealth addresses longstanding questions about North-South economic divergence and the role of state government in American industrial development.

In the Election of 1872 the conflict between President U. S. Grant and Horace Greeley has been typically understood as a battle for the soul of the ruling Republican Party. In this innovative study, Andrew Slap argues forcefully that the campaign was more than a narrow struggle between Party elites and a class-based radical reform movement. The election, he demonstrates, had broad consequences: in their opposition to widespread Federal corruption, Greeley Republicans unintentionally doomed Reconstruction of any kind, even as they lost the election. Christian G. Fritz looks at interposition, which is the practice of states opposing federal government decisions that were deemed unconstitutional. Interposition became a much-used constitutional tool to monitor the federal government and organize resistance, beginning with the Constitution's ratification and continuing through the present affecting issues including gun control, immigration and health care. Though the use of interposition was largely abandoned because of its association with nullification and the Civil War, recent interest reminds us that the federal government cannot run roughshod over states, and that states lack any legitimate power to nullify federal laws. Insightful and comprehensive, this appraisal of interposition breaks new ground in American political and constitutional history, and can help us preserve our constitutional system and democracy.
