Courts are constantly required to know how people think. They may have to decide what a specific person was thinking on a past occasion; how others would have reacted to a particular situation; or whether a witness is telling the truth. Be they judges, jurors or magistrates, the law demands they penetrate human consciousness. This book questions whether the `arm-chair psychology' operated by fact-finders, and indeed the law itself, in its treatment of the fact-finders, bears any resemblance to the knowledge derived from psychological research. Comparing psychological theory with court verdicts in both civil and criminal contexts, it assesses where the separation between law and science is most acute, and most dangerous.

Origins of the English Jury. Originally published: Jersey City: Frederick D. Linn, [1875]. x, 388 pp. First published in England in 1852, Forsyth's History of Trial by Jury is the first full-scale historical account of the rise and growth of the jury system in England. Highly regarded, this book went through 37 editions. The first American edition, the source of this reprint, adds a number of notes and corrections to American references in previous editions. "An excellent summary of the opinions of leading legal writers as well as conventional historians regarding the origins of trial by jury was set forth by an Englishman, William Forsyth, in his excellent book entitled History of Trial by Jury. (. . .) Various writers, according to Forsyth, attribute the origin of the English jury to a recognition of the principle that no man ought to be condemned except by the voice of his fellow citizens. Forsyth committed himself to the belief that trial by jury did not owe its existence to any positive law, that it was not created by any Act of Parliament, but grew out of usages and customs of society that eventually passed away. Forsyth concluded his observations by saying that "the jury does not owe its existence to any preconceived theory of jurisprudence, but that it gradually grew out of forms previously in use and was composed of elements long familiar to the people in general." -- Robert H. White, 29 Tennessee Law Review 29 (1961-1962) 14 William Forsyth [1812-1899] was an English lawyer and author of many works on law and literature, including The History of Lawyers (1849).

Reprint of a title from the Judicial Administration Series published by the National Conference of Judicial Councils. Originally published: New York: Published by the Law Center of New York University for the National Conference of Judicial Councils, 1952. xvi, 534 pp. Written near the end of Millar's career, the present study is a brilliant summary of his life's work. It discusses antecedents of the Anglo-American system, the evolution of procedure and American and English civil procedure in the nineteenth century. Other chapters discuss the development of specific areas, such as introduction of the cause, mode of trial and voluntary dismissal. "In a society which so often confuses quantity with quality - or at least tends to regard quantity as a necessary ingredient of quality - it is not surprising that American legal texts labeled "great" have generally been multi-volumed ones. While the number of volumes certainly does not detract from the worth of a Williston on Contracts or a Wigmore on Evidence, their sheer size has made them more easily recognizable, in our society, as classics. On the other hand, the single volume American law books receiving the label of greatness would make a sparse list indeed. To this elite list must now be added Professor Millar's Civil Procedure of the Trial Court in Historical Perspective." --Philip P. Kurland, Harvard Law Review 66 (1952-1953) 1542 Robert Wyness Millar [1876-1959], a professor at Northwestern University Law School, was a leading authority on civil procedure and its history. Miller 1937 Millar was the author of The Old Regime and the New in Civil Procedure (1937) and, with co-author Arthur Engelmann, A History of Continental Civil Procedure (1927).

Lysander Spooner's 'An Essay on the Trial By Jury' is a groundbreaking work that argues for the right of juries to determine not only the guilt of the accused but also the justice of the laws under which they are tried. In this volume, Spooner provides a comprehensive view of the English constitution, exposes the unconstitutional means by which trial by jury has been undermined, and shows that juries, in both England and the United States, are constitutionally empowered to make decisions based on Common Law principles. He explores the history, language, and moral considerations behind the Magna Carta, which enshrined the right to trial by jury. This book is an essential read for anyone interested in the fundamental principles of justice and the role of juries in upholding them.
