Only twenty years ago economists believed that the problem of modelling trade union behavior was almost intractable. Recently the economic theory of trade unions has experienced a remarkable revival. This study focuses on modern theories of collective bargaining. It addresses the problem whether these theories constitute useful and appropriate tools for analyzing the impact of trade unions on the wage formation process in The Netherlands. The Dutch industrial relations and labor market institutions may impose certain restriction on the applicability of collective bargaining theory. The study analyzes the way in which the outcome of bargaining is affected by the linking mechanism between private sector wages and unemployment benefits. It also discusses the relatively long duration of wage negotations. Furthermore, it couples the typical consensus attitude of the labor market p parties to wage bargaining and the low record of industrial disputes in The Netherlands.

Since the global financial crisis, sector-level bargaining has come under renewed scrutiny. While in Southern Europe, the crisis raised concerns about the role of collective bargaining as an obstacle to labor market adjustment, in Northern Europe it was perceived more favourably and, according to some, may even have helped to weather the fallout of the crisis more easily. This paper seeks to contribute to a deeper understanding of sector-level bargaining systems and their role for labor market performance. We compare two countries with seemingly similar collective bargaining systems, the Netherlands and Portugal, and document a number of features that may affect labor market outcomes, including: i) the scope for flexibility at the firm or worker level within sector-level agreements; ii) the emphasis on representativeness as a criterion for extensions; iii) the effectiveness of coordination across bargaining units; and iv) pro-active government policies to enhance trust and cooperation between the social partners.

Remarkably, the core element of labour relations?wage determination?has been excluded from the European social dialogue about harmonisation of working conditions and national systems of social security. The present study responds by analysing the prospects of building up structures of wage formation in Europe through a reevaluation of collective bargaining and collective agreements as they exist under the law of the most industrialized Member States. The impetus for the study is the widely debated crisis of the system of concluding regional collective agreements on wages. Social partners seem to have been trapped in fruitless conflicts on how the system must be reformed. It has become obvious that no party concerned employers, trade unions, the state has the capacity to resolve the growing difficulties of collective wage formation. In an introductory essay by the distinguished editors, this important study takes the situation in Germany, the most prominent manifestation of this European crisis, as its starting point. Then, academic experts from France, the United Kingdom, the Netherlands, and Sweden describe comparable problems in their own countries, detail approaches to dealing with them, and provide a critical commentary, including judgements and suggestions in relation to the German case. Then follows a reexamination of the situation in Germany in the light of the experience of the other countries. A final chapter outlines some preliminary interpretations of European prospects. Salient issues investigated include the following: the erosion of such ideological and legal categories and concepts as `dependent work, `solidarity', `subsidiarity' and `social self-regulation' as preconditions of traditional collective bargaining structures at national level; the decreasing membership of the bargaining partners on both sides; the shrinking rate of employees covered by collective agreements; attempts to establish a national social pact; increasing competition on global markets; decentralizing management strategies, including the abandonment of collective bargaining; and, individualized employees. The authors examine the various state structures to determine if the legal and institutional developments of the different national systems of collective bargaining constitute starting points for mutual learning in order to meet the new challenges. This leads to a discussion of which practices are successful in their original environment, and how these practices might adapt to other systems in other countries.

In the Netherlands collective bargaining between employers and employees is stimulated by legislation. Agreements reached through consultation between employers or employers' associations and one or more trade unions are explicitly favoured by the legislator. An arrangement based on a collective labour agreement (CLA) can emerge without the cooperation of a trade union. This may be the case if a works council is involved. Such arrangements are valued differently to CLAs, and will not automatically be incorporated in an employment contract.
