Although it is widely thought that structural linguistics began abruptly with the publication of Saussure's 'revolutionary' "Course in General Linguistics," the work of E. F. K. Koerner has demonstrated that Saussure, for all his originality, remained true to the basic tenets of his 19th-century predecessors. In this volume, the development of modern linguistics before, during and after Saussure is traced in 20 studies honouring the scholar who has done more than anyone else to professionalize linguistic historiography during the last quarter century. Among the wide range of topics covered are: grammar and philosophy in the age of comparativism, the relation of Saussure's anagram studies to his theory of the linguistic sign, nationalist overtones in German linguistics from 1914 to 1945, and the true story (with newly discovered documentation) of why Chomsky's "Logical Structure of Linguistic Theory" didn't get published during the 1950s or 60s. In addition to an introductory overview of Koerner's career and a complete listing of his publications, the volume includes previously unpublished materials from Saussure's notebooks.

Although semiotics has, in one guise or another, ftourished uninterruptedly since pre Socratic times in the West, and important semiotic themes have emerged and devel oped independently in both the Brahmanie and Buddhistic traditions, semiotics as an organized undertaking began to 100m only in the 1960s. Workshops materialized, with a perhaps surprising spontaneity, over much ofEurope-Eastern and Western and in North America. Thereafter, others quickly surfaced almost everywhere over the litera te globe. Different places strategically allied themselves with different lega eies, but all had a common thrust: to aim at a general theory of signs, by way of a description of different sign systems, their comparative analysis, and their classifi cation. More or less permanent confederations were forged with the most diverse academic disciplines, and amazingly varied frameworks were devised-suited to the needs of the times and the sites-to carry the work of consolidation forward. Bit by bit, mutually supportive international networks were put together. Today, it can truly be asserted that semiotics has become a global enterprise. This, of course, is far from saying that the map is uniform or even that world-wide homogeneity is in the least desirable. While our conjoint ultimate goal remains steadily in focus, the multiplicity of avenues available for its realization is inherent in the advent ure of the search itself.

A tese, sob a luz da Escola do Constructivismo do Professor Paulo de Barros Carvalho (filosofia da linguagem), avaliada com distinção em nota máxima, traz tema inovador, visto que propõe o controle da normatividade concreta decorrente do indexador-precedente. Nesse sentido, tem-se a disposição do art. 489, §2o; art. 525, §12 e segs, art. 535, §5° e segs, art. 966, CPC, além da querela nullitatis e outros indicativos de controle tratados. De igual forma, não se negam outras possibilidades, a exemplo da Arguição de Descumprimento de Preceito Fundamental, conforme ADPF 648, sob a relatoria da Ministra Cármen Lúcia Antunes Rocha. Contudo, a defesa central está na ação rescisória como controle da normatividade concreta da decisão projetada (art. 966, V, do CPC), em razão de sua abertura impugnativa (rol de legitimados/interesse jurídico), com maior democratização do controle sistêmico, além de servir para extirpar o indexador-precedente ofensivo à unidade do ordenamento. Os legitimados à ADPF se apresentam em âmbito mais restrito. Já o controle individual em cada processo, possibilitado pelo §2o, do art. 489 do CPC, não terá o feito de retirar o indexador viciado do sistema, bem como verter benefícios a outros interessados. No Brasil, os “precedentes” foram criados para racionalizar o número de demandas existentes e equacionar “fórmulas” à isonomia da prestação da tutela jurisdicional. Contudo, sua inserção não previu “hipóteses de correção” quando a sua base é um ato de desvio (ilícito, abusivo ou não conformativo). Esta tese, sob o eixo da filosofia da linguagem, com o uso da metodologia do Constructivismo Lógico-semântico, pretende não somente questionar a figura do enunciado-judicial-indexador, sob uma historicidade crítica do que se convencionou chamar de “precedentes”, mas também propõe caminho para se resolver possíveis descontroles “assistêmicos” das emanações habilitadas à indexação. Defende-se, com mais vigor, nesse âmbito, a ação rescisória (art. 966, V, CPC) para fins de uma efetiva dinâmica constitucional da normatividade concreta do acórdão-base, habilitado à projeção, sem prejuízo de outros nortes impugnativos e enfrentamentos discursivos. Objetiva-se, assim, uma leitura conformativa do processo diante do novo instituto à parametrização de julgamentos, para que o seu espaço sirva de instrumental à integridade pragmática do ordenamento jurídico brasileiro.
