La tradition de la science juridique européenne a longtemps fait une place, à côté des manuels de droit constitutionnel destinés à des étudiants débutants ou des monographies portant sur des questions spécifiques, à des traités ambitieux qui témoignent de " l'état de l'art ". C'est avec cette tradition qu'il est nécessaire de renouer en raison des profondes transformations qui ont affecté aussi bien le fond du droit constitutionnel que la science qui le prend pour objet. Le renouveau du droit constitutionnel résulte en grande partie du prodigieux développement de la justice constitutionnelle. II est aussi façonné par la naissance d'un ordre juridique européen et international qui dépasse le cadre de l'Etat. Enfin ce mouvement se conjugue avec une force du discours constitutionnel qui se diffuse dans le débat politique économique et social à l'échelle planétaire. Ce droit est donc aujourd'hui mondial. II opère à l'aide de concepts généraux et désormais souvent universels. D'autre part, le droit constitutionnel ne peut plus être analysé sans référence à d'autres disciplines que la science juridique. II fallait donc un ouvrage qui soit international par son objet, par sa méthodologie et par ses auteurs. Ce traité devait également être conçu et rédigé à un niveau théorique assez élevé mais accessible au plus grand nombre, pour permettre de rendre compte de l'infinie variété des droits positifs et des pratiques contemporaines. De fait, il réunit quelques-uns des plus grands noms de la discipline, qui appartiennent à des cultures juridiques différentes, à des écoles doctrinales diverses mais ont l'habitude de débattre entre elles. Ce traité est le lieu de ces débats et sera une référence pour ceux qui les poursuivent et contribuent à la culture constitutionnelle commune.
