Public and Private Participation in the Water and Wastewater Sector provides practical guidance on applying Public Private Partnership structures within the constraints of European legislation, with examples on how to ensure consistency with EU procurement, competition law and the Water Framework Directive. It reconciles the need for adequate regulation within the context of a monopoly provision of service – a major concern of the European competition policy. The purpose of this book is to provide practical guidance on how to introduce a Public Private Partnership (PPP) as a strategy towards helping meet the demands for massive capital investments and improved management and performance in the water and wastewater sector. The introduction of PPPs within a European context needs to be assessed against compliance with basic EU law principles related to Competition and the Water Framework Directive. International legal structures in the management, distribution and treatment of water are discussed. The Government of Pakistan strongly supports public–private partnership (PPP) initiatives. From 1990 to 2019, Pakistan witnessed 108 financially closed PPP projects, with a total investment of approximately $28.4 billion. About 88% of these projects are in the energy sector, attracting more than $24.7billion, followed by investments in the port sector. In early 2021, Parliament approved the amendments to the 2017 PPP Law, enacting the Public Private Partnership Authority (Amendment) Act 2021. This further strengthens the enabling legal and regulatory framework for developing and implementing PPPs, thereby promoting private sector investment in public infrastructure and related services.

Given the success of the Private Finance Initiative in the United Kingdom and the large-scale ideological shift to neoliberalism, supporters of public-private partnerships (PPPs) argue that the theoretical benefits of the management approach (innovative financial mechanisms, budgetary relief, increased economic and technical efficiency, and transfer of risk to the private partner) can allow governments in low-income nations to close the infrastructure gap in the water sector. Utilizing a Social Ecological framework, this Master's Thesis examines these claims by identifying the sources of supply and demand for Water, Sanitation, and Health (WASH) PPPs. Drawing from the World Bank Private Participation in Infrastructure database, the research discovers that the majority of projects are found in middle-income economies, with investment stemming primarily from public---rather than private---partners. The data also reveals that despite being touted as a panacea for development and growth, since the 1990s PPPs are responsible for only 11.12 percent of gained water access. Given the high cost of project cancellation and distress in the water sector (20 percent of total investment), the thesis also explores the Critical Success Factors (CSFs) that determine project success. A thorough literature review based on both outcome- and output-based project metrics revealed a total 13 CSFs. The thesis concludes that given the high economic, political, and social requirements of these partnerships, in its present form, the management approach is not an appropriate solution for promoting WASH infrastructural growth in developing economies.

The Model Legislative Provisions and the Legislative Guide on Public-Private Partnerships were prepared by the United Nations Commission on International Trade Law (UNCITRAL) and adopted at its fifty-second session (Vienna, 8-19 July 2019). In addition to representatives of member States of the Commission, representatives of many other States and of several international organizations, both intergovernmental and non-governmental, participated actively in the preparatory work. The Model Legislative Provisions translate into legislative language the advice given in the recommendations contained in the Legislative Guide. The Model Legislative Provisions are intended to assist in the establishment of a legislative framework favourable to public-private partnerships (PPPs). The Model Legislative Provisions follow the corresponding notes in the Legislative Guide, which offer an analytical introduction with references to financial, regulatory, legal, policy and other issues raised in the subject area. The user is advised to read the Model Legislative Provisions together with the Legislative Guide, which provide background information to enhance understanding of the legislative recommendations. The Model Legislative Provisions deal with matters that it is important to address in legislation specifically concerned with PPPs. They do not deal with other areas of law that, as discussed in the Legislative Guide, also have an impact on PPPs. Moreover, the successful implementation of PPPs typically requires various measures beyond the establishment of an appropriate legislative framework, such as adequate administrative structures and practices, organizational capability, technical expertise, appropriate human and financial resources and economic stability.
