No entanto, se para um adulto essa situação é complexa e envolve muitas questões difíceis que requerem suporte multidisciplinar, para uma criança, essa complexidade é ainda maior, desde seu diagnóstico até o momento do tratamento hormonal – e é nesse contexto que se desenvolverá o presente estudo. O problema se agrava quando há divergência entre a vontade dos pais e o desejo dos filhos, seja por “princípio moral”, ideologia, religião ou qualquer outra justificativa. Eis a situação: de um lado está a vontade do menor, seu direito ao próprio corpo, dignidade, integridade física, moral e psicológica, considerando sua imaturidade natural. Há a sua autonomia de vontade, hoje tutelada pelo direito. De outro, os pais e o poder familiar: é dever dos pais de decidir sobre a vida e saúde do filho. A autoridade parental tem novos contornos e não pode desconsiderar que está a tratar da vida de outra pessoa, cuja personalidade deve ser respeitada, deve ser levada em consideração. Questões complexas e novas ao direito, onde a lei não é ainda capaz de responder, mas que a jurisprudência e a doutrina se esforçam para atender. Para compreender o tema, é necessário entender o contexto social das pessoas transexuais, termos e definições utilizados para tratar o assunto, mas, sobretudo, despir-se de qualquer preconceito, pois, é um tema tão sensível quanto seus sujeitos.
