O Tratado de Confissão, impresso em Chaves em 1489, é um manual para instrução do clero na difícil tarefa de ministrar o sacramento da penitência aos fiéis cristãos. Bastante polémico e politicamente incorrecto aos olhos actuais, ele é um retrato bastante realista dos comportamentos desviantes dos cristãos do século XV, especialmente no âmbito sexual. Nele são tratados em pormenor o adultério, a violação ou estupro, a pedofilia, o incesto, o aborto e a homossexualidade. Esta nova edição, além do estudo introdutório, contém a edição semidiplomática da obra (de acordo com a edição de 1489), a edição actualizada para um público pouco familiarizado na leitura de textos portugueses antigos e a lematização do vocabulário. José María Soto Rábanos diz o seguinte acerca desta obra: «El tratado no me parece obra de autor, por varias razones que se podrían resumir en una: no tiene la estructura que se le supone a una obra de autor. Para empezar, en el prólogo no hay alusión alguna expresa a la motivación del escrito, como suele suceder en los tratados de autor; sino que se empieza directamente con la figura del prelado-juez. Ni siquiera se utilizan términos de carácter sacramental, como los de: pecado, confesión, confesor, penitente, sino términos más propios del ámbito normativo y, en concreto, judicial, como los de: juez, prelado, delito, sentencia, acusado. El discurso prologal se acompaña de citas, tipo ético, de Aristóteles, morales de san Bernardo y jurídicas de san Ambrosio. La única mención a penitencia y a pecado, en este ambiente judicial, llega en la última frase del prólogo, en la que se anota, sin precisar, la pena que debe sufrir un juez por dar una sentencia contra derecho: "E este tall por este pecado deue a receber mui grande peemdemça".»

Knowledge of the pragmatici sheds new light on pragmatic normative literature (mainly from the religious sphere), a genre crucial for the formation of normative orders in early modern Ibero-America. Long underrated by legal historical scholarship, these media – manuals for confessors, catechisms, and moral theological literature – selected and localised normative knowledge for the colonial worlds and thus shaped the language of normativity. The eleven chapters of this book explore the circulation and the uses of pragmatic normative texts in the Iberian peninsula, in New Spain, Peru, New Granada and Brazil. The book reveals the functions and intellectual achievements of pragmatic literature, which condensed normative knowledge, drawing on medieval scholarly practices of ‘epitomisation’, and links the genre with early modern legal culture. As Constituições são, de acordo com os conhecimentos actuais, o quinto livro impresso em língua portuguesa. O impressor Rodrigo Álvares, de acordo com o cólofon do incunábulo, acabou de compor o texto no dia 4 de Janeiro de 1497, a mando do bispo do Porto D. Diogo de Sousa (1460-1532?). Este bispo, doutorado em Teologia pela Universidade de Paris, foi um dos mais ilustrados homens da Igreja portuguesa da época. Em 1495 foi nomeado bispo da diocese do Porto e em 1496 convocou um sínodo episcopal, que se reuniu a 24 de Agosto na mesma cidade. Desse sínodo foram exaradas sessenta constituições, ou directivas, que regulamentavam a vida religiosa dos clérigos, abades, reitores, priores e fiéis cristãos da sua diocese.

This volume is the sixth in the Series The Judges, which collects and synthesizes the opinions of leading international Judges of the contemporary era who have contributed significantly to the progressive development of international law.
