La obra adopta la forma del tratado, con el objeto de permitir una exposición sistemática de los temas que constituyen su objeto y ganar rigor analítico. Se han tenido en cuenta los derechos de otras jurisdicciones, así como su jurisprudencia y, muy en particular, la del Tribunal de Justicia de las Comunidades Europeas.
