Il Decreto Legge 30 dicembre 2005, n. 273, convertito, con modificazioni, nella Legge 23 febbraio 2006, n. 51, ha introdotto nell’ordinamento giuridico italiano l’art. 2645-ter c.c., che dispone la trascrizione degli atti di destinazione per la realizzazione di interessi meritevoli di tutela., e precisamente atti idonei alla separazione del patrimonio (o parte di esso), per perseguire uno specifico interesse.
