Kassin and Wrightsman's book concentrates on the single most important determinant of verdicts -- the evidence and court procedure. It is divided into four parts: (1) an overview and historical perspective; (2) seven substantive topics like eyewitness accounts, confessions, and character evidence; (3) an examination of the major stages of trial procedure; and (4) a provocative discussion of the role that psychology does, and should, play in the judicial process. Written in non-technical language, this book should have a broad appeal to students, researchers and litigants alike. `Chapters are extremely well written and documented. What are the aims of a criminal trial? What social functions should it perform? And how is the trial as a political institution linked to other institutions in a democratic polity? What follows if we understand a criminal trial as calling a defendant to answer to a charge of criminal wrongdoing and, if he is judged to be responsible for such wrongdoing, to account for his conduct? A normative theory of the trial, an account of what trials ought to be and of what ends they should serve, must take these central aspects of the trial seriously; but they raise a number of difficult questions. They suggest that the trial should be seen as a communicative process: but what kinds of communication should it involve? What kind of political theory does a communicative conception of the trial require? Can trials ever actually amount to more than the imposition of state power on the defendant? What political role might trials play in conflicts that must deal not simply with issues of individual responsibility but with broader collective wrongs, including wrongs perpetrated by, or in the name of, the state? These are the issues addressed by the essays in this volume. The third volume in this series, in which the four editors of this volume develop their own normative account, will be published in 2007.

Victims And The Criminal Trial written by Tyrone Kirchengast and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-08-10 with Social Science categories.

This book addresses the idea that victims remain contested and controversial participants of justice in the twenty-first century adversarial criminal trial. Victims are increasingly participating in all phases of the criminal trial, with new substantive and procedural rights, many of which may be enforced against the state or defendant. This movement to substantive rights has been contentious, and evidences a contested terrain between lawyers, defendants, policy-makers and even victims themselves. Bringing together substantial source materials from law and policy, this book sets out the rights and powers of the victim throughout the phases of the modern adversarial criminal trial. It examines the role of the victim in pre-trial processes, alternative pathways and restorative intervention, the jury trial, sentencing, appeal and parole. Preventative detention, victim registers, criminal injuries compensation and victim assistance, restitution and reparations, and extra-curial rights and declarations are examined to set out the rights of victims as they impact upon and constitute aspects of the modern criminal trial process. The adversarial criminal trial is also assessed in the context of the increased rights of victims in international law and procedure, and with reference to policy transfer between civil and common law jurisdictions. This timely and comprehensive book will be of great interest to scholars of criminology, criminal law and socio-legal studies.

Theoretical Foundations Of Criminal Trial Procedure written by Paul Roberts and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014 with Criminal procedure categories.

The articles and essays reproduced in this volume explore the 'theoretical foundations' of 'criminal trial procedure'. This is a precise, but also fundamentally question-begging, description of the book's scope and ambitions. Viewed in isolation, each of the components of its title might be regarded as conceptually problematic. There are well-rehearsed difficulties, for example, in separating 'trials' form 'pre-trial' proceedings, partly because the trial/pre-trial dichotomy is an artefact of institutional procedural traditions and different legal systems draw the line in different places, for reasons that seem to them compelling but would not necessarily be viewed as logical by foreign observers.

Trial Fundamentals written by Mark S. Curry and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-08-27 with categories.

Trial Fundamentals is a concise and practical handbook setting forth the nuts and bolts of trying a (non-criminal) case before a jury or the court. It covers not only basic trial procedure and the rules of evidence commonly used in the courtroom, but also explains basic strategies and trial skills necessary to try a case, such as tips on how to select a jury, how to effectively cross-examine and impeach a witness, and strategies for making a persuasive closing argument. Using California's rules of evidence and procedure for reference, the handbook follows the natural progression of a trial from the motions in limine through jury deliberation, and everything in between. Written by a Superior Court judge in California with more than 30 years of courtroom experience, the handbook includes explanation and commentary on the following areas: * In limine motions* Jury selection* Opening statements* Direct examination* Cross-examination* Witness impeachment* Witness rehabilitation* Expert witnesses* Hearsay* Character evidence* Courtroom evidence* Trial objections* Closing argument* Deliberations In addition, the handbook contains numerous "trial tips," practical real-world suggestions by the author concerning courtroom presentation and trial etiquette, not found in other more formal trial treatises. Because a substantial portion of the handbook is devoted to basic trial skills and strategies, and because California's rules of evidence mirror, or are very similar to, many other jurisdictions, the handbook is also useful to practitioners outside California. The handbook is meant to set forth the basic fundamentals of a trial, both procedural and practical, in a concise, and easy-to-follow format. It is an excellent refresher for experienced trial counsel and a good learning resource for the less-experienced and law students learning the trade. For the fundamentals of a criminal trial see Criminal Trial Handbook, also published by the author.
