Al giorno d’oggi è piuttosto consueto che si parli di incentivi e premi. Se infatti la funzione promozionale da sempre appartiene al diritto, essa pare aver conseguito una accresciuta rilevanza nell’attuale assetto dei rapporti socio-economici. Nell’opera monografica, l’indagine è volta a verificare se ed entro quali limiti le parti possano decidere di privilegiare, rispetto alla generale tutela risarcitoria contro il danno da inadempimento, un apparato rimediale positivo di coercizione indiretta all’adempimento, sino al limite di una sostituzione del generale rimedio negativo e successivo del risarcimento dei danni, con il rimedio di tipo preventivo e positivo della ricompensa per l’adempimento. Prima di trattare dell’obbligazione e del relativo sistema rimediale, inserite nella cornice sistematica elaborata dagli studiosi di teoria generale del diritto che si sono occupati di sanzioni positive, trovano spazio alcune tra le ipotesi di diritto premiale registrabili in ambito privatistico sia nel diritto oggettivo, che nella autonomia privata.

This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field.
