This is the summary of an oral briefing given in response to a mandate in the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009. This mandate required the Dept. of Homeland Security (DHS) to prepare an expenditure plan that satisfied 12 specified conditions, and for the plan to be submitted to and approved by the House and Senate Appropriations Committees before the agency could obligate $400 million of the approx. $775 million appropriated for U.S. Customs and Border Protection fencing, infrastructure, and technology. A mandate in the Dept. of Defense (DOD) and Full-Year Continuing Appropriations Act, 2011 required the Dept.of Homeland Security (DHS) to (1) update its FY 2010 expenditure plan on border security fencing, infrastructure, and technology (BSFIT) for FY 2011 budget authority and (2) submit the updated plan to the House and Senate Appropriations Committees. The plan is to address 10 legislative conditions in the FY 2010 DHS appropriations act and be reviewed by GAO. DHS submitted an updated plan to Congress on September 8, 2011. This report reviewed the plan. It analyzed the expenditure plan and documents referenced within the plan, such as strategic plans and reports, and interviewed DHS and U.S. Customs and Border Protection (CBP) officials to obtain clarification on material contained in the expenditure plan, including certification memoranda from the DHS Chief Procurement, Chief Information, and Chief Human Capital Officers. In November 2005, the Department of Homeland Security (DHS) announced the launch of the Secure Border Initiative (SBI), a multiyear, multibillion-dollar program aimed at securing U.S. borders and reducing illegal immigration. The expenditure plan did not fully satisfy all of the legislative conditions and committee reports' directions. Specifically, of the 11 legislative conditions, the expenditure plan satisfied 4, partially satisfied 6, and did not satisfy 1. Also, of the 7 committee reports' directions, the expenditure plan satisfied 2 and partially satisfied 5. Based on the results of our review, we are not making any recommendations for congressional consideration or agency action. We provided a draft of this report to DHS for review and comment. In commenting on a draft of this report, DHS responded to the findings related to 1 of the 11 legislative conditions and did not comment on the findings related to the 7 committee reports' directions. Specifically, DHS stated that it concurred in part with our assessment of partially satisfied for legislative condition 8. This condition requires that the expenditure plan include a certification by the DHS Chief Procurement Office (CPO) that the program (1) complies with DHS's acquisition management review process, among other things; (2) meets federal acquisition requirements; and (3) is adequately staffed. The condition also requires that the plan includes required supporting documentation used to obtain this certification.

This book examines the funding, technologies and enforcement used to keep our borders secure.Chapter 1 reviews the critical infrastructure, technology, and personnel funding needed by U.S. Customs and Border Protection to enhance our Nation�s border security. On January 25, 2017, in one of his first acts as President, Donald Trump ordered �the immediate construction of a physical wall on the southern border. As reported in chapter 2, Border Patrol agents have rarely recommended building a wall to address the most commonly identified vulnerabilities � or �capability gaps� � along the southwest border. More often, agents recommended additional technology and personnel as solutions for securing the border.The U.S. Border Patrol, within the Department of Homeland Security�s (DHS) U.S. Customs and Border Protection (CBP), has made progress deploying surveillance technology�a mix of radars, sensors, and cameras�along the southwest U.S. border as described in chapter 3.There is a wave of foreign nationals headed for the U.S. southern border. Chapter 4 discusses the impending arrival of what was initially called an immigrant caravan, which remains a challenge of U.S. border security. The San Diego-based group, Pueblo Sin Fronteras, or People Without Borders, has taken credit for organizing the effort. While they claim to provide humanitarian aid to migrants and refugees, what they are doing now is undermining the rule of law.Chapter 5 highlights the potential vulnerabilities in the visa issuance process. U.S. Immigration and Customs Enforcement (ICE), a component within the Department of Homeland Security (DHS), implemented the Visa Security Program (VSP) in 2003. ICE has since deployed officials to certain U.S. embassies and consulates overseas to strengthen the visa review process by working with Department of State (State) consular officers in reviewing applications.

Border enforcement is a core element of the Department of Homeland Security's effort to control unauthorized migration, with the U.S. Border Patrol (USBP) within the U.S. Customs and Border Protection (CBP) as the lead agency along most of the border. Border enforcement has been an ongoing subject of congressional interest since the 1970s, when illegal immigration to the United States first registered as a serious national problem; and border security has received additional attention in the years since the terrorist attacks of 2001. Since the 1990s, migration control at the border has been guided by a strategy of "prevention through deterrence"-the idea that the concentration of personnel, infrastructure, and surveillance technology along heavily trafficked regions of the border will discourage unauthorized aliens from attempting to enter the United States. Since 2005, CBP has attempted to discourage repeat illegal migrant entries and disrupt migrant smuggling networks by imposing tougher penalties against certain unauthorized aliens, a set of policies eventually described as "enforcement with consequences." Most people apprehended at the Southwest border are now subject to "high consequence" enforcement outcomes. Across a variety of indicators, the United States has substantially expanded border enforcement resources over the last three decades. Particularly since 2001, such increases include border security appropriations, personnel, fencing and infrastructure, and surveillance technology. In addition to increased resources, the USBP has implemented several strategies over the past several decades in an attempt to thwart illegal migration. Recently, the Obama Administration announced executive actions to "fix" the immigration system. These actions address numerous issues, including a revised security plan at the southern border. The Border Patrol collects data on several different border enforcement outcomes; and this report describes trends in border apprehensions, recidivism, and estimated got aways and turn backs. Yet none of these existing data are designed to measure illegal border flows or the degree to which the border is secured. Thus, the report also describes methods for estimating illegal border flows based on enforcement data and migrant surveys. Drawing on multiple data sources, the report suggests conclusions about the state of border security. Robust investments at the border were not associated with reduced illegal inflows during the 1980s and 1990s, but a range of evidence suggests a substantial drop in illegal inflows in 2007-2011, followed by a slight rise in 2012 and a more dramatic rise in 2013. Enforcement, along with the economic downturn in the United States, likely contributed to the drop in unauthorized migration, though the precise share of the decline attributable to enforcement is unknown. Enhanced border enforcement also may have contributed to a number of secondary costs and benefits. To the extent that border enforcement successfully deters illegal entries, such enforcement may reduce border-area violence and migrant deaths, protect fragile border ecosystems, and improve the quality of life in border communities. But to the extent that aliens are not deterred, the concentration of enforcement resources on the border may increase border area violence and migrant deaths, encourage unauthorized migrants to find new ways to enter illegally and to remain in the United States for longer periods of time, damage border ecosystems, harm border-area businesses and the quality of life in border communities, and strain U.S. relations with Mexico and Canada.

In November 2005, the Department of Homeland Security (DHS) announced the launch of the Secure Border Initiative (SBI), a multiyear, multibillion dollar program aimed at securing U.S. borders and reducing illegal immigration. Within DHS, U.S. Custom and Border Protection's (CBP) SBI program is responsible for developing a comprehensive border protection system using technology, known as SBInet, and tactical infrastructure -- fencing, roads, and lighting. GAO was asked to provide periodic updates on the status of the program. This report addresses (1) the extent to which CBP has implemented SBInet and the impact of delays that have occurred, and (2) the extent to which CBP has deployed tactical infrastructure and assessed its results. To do this work, GAO reviewed program schedules, status reports, and previous GAO work; interviewed DHS and CBP officials, among others; and visited three SBI sites where initial technology or fencing had been deployed at the time of GAO's review. GAO recommends that the Commissioner of CBP conduct a cost-effective evaluation of the impact of the tactical infrastructure's contribution to border security. DHS agreed with this recommendation.
