This is the second part of land studies on Northern Uganda designed to inform the Peace, Recovery and Development Plan (PRDP). This second part of the study, undertaken during the second half of 2007 in the Lango and Acholi regions, builds on the first phase conducted in 2006 in the Teso region. This second study has been designed to present a more quantitative analysis of trends on disputes and claims on land before displacement, during displacement and on return of Internally Displaced Persons (IDPs) in the greater conflict areas of Acholi and Lango regions. The study found that the return from IDP camps to original homes was progressing with varied results tied to the length of time spent in the camps, from 5 to 15 years. About 85 percent of the respondents had experienced threats to tenure security, and many felt these threats were significant. Misgivings exist about the Central Government's intentions towards land. Disputes mainly occurred on land abandoned upon displacement, with border disputes being the most prevalent. The study also looked into land administration, land titling and registration, extremely vulnerable individuals, and legal loopholes. It gives several recommendations, both immediate and long term actions, which can be incorporated and implemented as part of the PRDP.

Claims to land and territory are often a cause of conflict, and land issues present some of the most contentious problems for post-conflict peacebuilding. Among the land-related problems that emerge during and after conflict are the exploitation of land-based resources in the absence of authority, the disintegration of property rights and institutions, the territorial effect of battlefield gains and losses, and population displacement. In the wake of violent conflict, reconstitution of a viable land-rights system is crucial: an effective post-conflict land policy can foster economic recovery, help restore the rule of law, and strengthen political stability. But the reestablishment of land ownership, land use, and access rights for individuals and communities is often complicated and problematic, and poor land policies can lead to renewed tensions. In twenty-one chapters by twenty-five authors, this book considers experiences with, and approaches to, post-conflict land issues in seventeen countries and in varied social and geographic settings. Highlighting key concepts that are important for understanding how to address land rights in the wake of armed conflict, the book provides a theoretical and practical framework for policy makers, researchers, practitioners, and students. While there is a large, though inconclusive, literature on the impact of land titles in Africa, little attention has been devoted to the study of land conflict, despite evidence on increasing incidence of such conflicts. Deininger and Castagnini use data from Uganda to explore who is affected by land conflicts, whether recent legal changes have helped to reduce their incidence, and to assess their impact on productivity. Results indicate that female-headed households and widows are particularly affected and that the passage of the 1998 Land Act has failed to reduce the number of pending land conflicts. The authors also find evidence of a significant and quantitatively large productivity-reducing impact of land conflicts. This suggests that, especially in Africa, attention to land-related conflicts and exploration of ways to prevent and speedily resolve them would be an important area for policy as well as research. This paper--a product of Rural Development, Development Research Group--is part of a larger effort in the group to explore the impact of land policies.

This collection clarifies the background of land and property problems in conflict-affected settings, and explores appropriate policy measures for peace-building. While land and property problems exist in any society, they can be particularly exacerbated in conflict-affected settings – characterized by unstable security, weak governance, loss of proper documentation as well as the return of refugees and Internally Displaced Persons. Unless these problems are properly addressed, they can destabilize fragile political order and hinder economic recovery. Although tackling land and property problems is an important challenge for peace-building, it has been relatively neglected in recent debates about liberal peace-building as a result of the strong focus on state-level institution building, such as security sector reforms and transitional justice. Using rich original data from eight conflict-affected countries, this book examines the topic from the viewpoint of State-society relationship. In contrast to previous literature, this volume analyses land and property problems in conflict-afflicted areas from a long-term perspective of state-building and economic development, rather than concentrating only on the immediate aftermath of the conflict. The long-term perspective enables not only an understanding of the root causes of the property problems in conflict-affected countries, but also elaboration of effective policy measures for peace. Contributors are area specialists and the eight case study countries have been carefully selected for comparative study. The collection applies a common framework to a diverse group of countries – South Sudan, Uganda, Rwanda, Burundi, Cambodia, Timor-Leste, Colombia, and Bosnia-Herzegovina.

For the last three decades, Uganda has been one of the fastest growing economies in Africa. Globally praised as an African success story and heavily backed by international financial institutions, development agencies and bilateral donors, the country has become an exemplar of economic and political reform for those who espouse a neoliberal model of development. The neoliberal policies and the resulting restructuring of the country have been accompanied by narratives of progress, prosperity, and modernisation and justified in the name of development. But this self-celebratory narrative, which is critiqued by many in Uganda, masks the disruptive social impact of these reforms and silences the complex and persistent crises resulting from neoliberal transformation.
