Die Wahl des Titels fiir diesen Sammelband ist sowohl deskriptiv als auch normativ motiviert. Zum einen basiert sie auf der Be obachtung, daB das Umweltrecht im Zeichen der sich verscharfen den okologischen Krise in einem lebhaften EntwicklungsprozeB begriffen ist. Und zum anderen manifestiert sie die - nicht zu letzt in den hier vorgelegten Arbeiten bezeugte - Bemiihung des Verfassers, diesen WandlungsprozeB rechtspolitisch mitzu gestalten. Es ist dies eine Bemiihung, die umso dringlicher erscheint, als die okologische Aufklarung zwar in einem standigen Fortschrei ten begriffen ist, gerade bei der rechtlich-politischen Umsetzung in Entscheidungen von gesamtgesellschaftlicher Relevanz jedoch stets aufs neue im Sog der - von einer offenbar unausrottbaren Wachstumseuphorie gepragten - okonomischen Reaktion ver schleiert und verfalscht zu werden droht. Zu verhindern, daB die allenthalben aufkeimenden umweltpolitischen Impulse in eine bloBe "Politik des peripheren Eingriffs" (Doran/Hinz/Mayer Tasch) miinden, bedarf es konzentrierter Anstrengungen auf allen Ebenen staatlicher Ordnungs- und Verteilungspolitik. Wie die Erfahrung lehrt, kommt dabei der administrativen und judikativen Rechtsanwendung entscheidende Bedeutung zu. Die bemiihtesten Gesetze bleiben Makulatur, wenn das Informa tionsniveau und das VerantwortungsbewuBtsein der Rechtsan wender sie nicht mit Leben erfiillt. 1m BewuBtseindieses Dilem mas mochte ich dieses Biichlein dem (mehr oder weniger) "unbe kannten Verwaltungsrichter" widmen, dem in dem schicksal haften Fuchs- und Has-Spiel von okologischer Info~ation und okonomischer Reaktion, dessen Zeugen wir allenthalben werden, eine Schliisselrolle zukommt. English summary: Purpose thinking is something administrative law has been familiar with all times. Katharina Schober therefore begins her examination by studying the historical development of the application of purposes in administrative law. In doing so, she shows that a purpose orientation in the law is unavoidable, yet problematical because of the vagueness of purposes which eases the judicial attachment of administration and judicature. Due to the increasing finalization of administrative law, the problem of the vagueness of purposes is more urgent today than it used to be. Lawmakers are increasingly trying to solve this problem by using guidelines, with which they can make the purpose for which they are striving more concrete. Katharina Schober examines the extent to which this approach to a solution has been successful in a comprehensive empirical analysis of the way in which 22 guidelines in environmental law are dealt with in legislation, judicial decisions and literature. German description: Das Zweckdenken ist dem Verwaltungsrecht seit jeher vertraut. Ausgangspunkt der Untersuchung von Katharina Schober ist daher die historische Entwicklung der Verwendung von Zwecken im Verwaltungsrecht. Sie zeigt, dass eine Zweckorientierung im Recht unausweichlich ist, wenn man nicht bei einem vordergrundigen Wortlautverstandnis stehen bleiben will. Durch ihre Subjektivitat, Vielschichtigkeit und schwere Fassbarkeit stellen Zwecke jedoch zugleich einen Unsicherheitsfaktor dar, der die Gesetzesbindung von Verwaltung und Rechtsprechung lockert. Aufgrund der zunehmenden Finalisierung des Verwaltungsrechts in den letzten Jahrzehnten scheint das Problem der Vagheit von Zwecken heute drangender zu sein als fruher. Ein Losungsansatz, auf den der Gesetzgeber in neuerer Zeit immer haufiger zuruckgreift, stellen die sogenannten Leitvorschriften dar, mit denen der Gesetzgeber die von ihm verfolgten Zwecke in einem der ersten Paragraphen des Gesetzes naher konkretisieren kann. Wie Katharina Schober in einer ubergreifenden empirisch fundierten Analyse des Umgangs von Gesetzgebung, Rechtsprechung und Literatur mit 22 Leitvorschriften in Umweltrechtsgesetzen zeigt, bleibt diese Konkretisierung in der Praxis jedoch aus. Den untersuchten Leitvorschriften mangelt es insbesondere an hinreichender Klarheit. Ferner fehlt es nicht selten an einer Kongruenz der Leitvorschrift mit dem nachgestellten Gesetz. Eine starkere Bindung von Verwaltung und Rechtsprechung an die gesetzgeberischen Grundentscheidungen vermogen die geltenden Leitvorschriften somit nicht zu gewahrleisten. Dies zeigt sich auch darin, dass Rechtsprechung und Literatur den umweltrechtlichen Leitvorschriften keine grosse praktische Bedeutung beimessen. Die Wirkung der Leitvorschriften ist somit weniger eine tatsachliche als eine symbolische.

It is a commonplace that pollution knows no borders, and that environmental law must allow for cross-border implementation. The European Union specifies this principle in EC directives on integrated pollution prevention and control (IPPC), on environmental impact assessment (EIA), and on the control of major accident hazards involving dangerous substances (Seveso II). This is the first book to investigate from both empirical and normative perspectives the effectiveness of these directives at the national level. It provides by far the most extensive comparative analysis and evaluation of the industrial permitting and inspections, EIA, and major accident prevention in the EU. Offering an in-depth study of the transposition and implementation of EC environmental directives in eight EU member states (Denmark, France, Germany, Italy, the Netherlands, Spain, Sweden, and the United Kingdom), the author who has played a significant role in the formulation of environmental legislation and regulation at both the national (German) and EU levelsand¿provides a stable base for an assessment of the benefits and costs of the integrated approach to environmental protection. Among the factors considered are the following: key features of national constitutional, administraand¬tive, and judicial systems which provide the framework for environand¬mental regulations and their implementation in the eight countries under study; procedures and substantive requirements transposing the IPPC, EIA and Seveso II directives into national laws; and evaluation of national deficiencies and the extent of muddling through. The empirical part of Dr Bohne's analysis draws on 138 expert interviews with public and private actors, a survey of 178 public authorities, and document analyses of selected industrial permits and environmental impact statements. His comparative analysis of procedural, organizational, and substantive integration makes it possible to identify and compare national accomplishments in regulatory integration, and offers new insights into the effectiveness and limits of EC law. The study concludes with a discussion of the implications of the findings for European governance and better regulation after the enlargement of the EU.
