A democracia actual cada vez está máis limitada a aspectos formais, nunha versión procedimental e elitista da mesma. Vivimos un estado de cousas onde os gobernos democraticamente elixidos teñen cada vez máis restrinxida a súa capacidade de actuación nas políticas económicas, rompendo cos compromisos adquiridos e frustrando as expectativas de quen os elixiron. A condición de cidadán muda na dun súbdito, cuxa única esfera de poder redúcese ao ámbito privado, e onde a maior liberdade é a de consumir cando dispón de medios suficientes. Neste mundo económico global, e no estado de excepción permanente que o acompaña, os dereitos sociais vanse baleirando fronte á mercantilización da vida. Todas estas razóns esixen entender a desobediencia civil como unha figura complexa que comparte elementos co resto das outras figuras e estratexias que implican desobediencia e resistencia perante o poder. Achámonos, pois, en situación de comezar a pensar a desobediencia civil no sentido máis amplo e aberto dunha desobediencia tamén social e política.

The concept of convention has been used in different fields and from different perspectives to account for important social phenomena, and the legal sphere is no exception.
