Ancillary services are those functions performed by the equipment and people that generate, control, and transmit electricity in support of the basic services of generating capacity, energy supply, and power delivery. The Federal Energy Regulatory Commission (FERC) defined such services as those 'necessary to support the transmission of electric power from seller to purchaser given the obligations of control areas and transmitting utilities within those control areas to maintain reliable operations of the interconnected transmission system.' The nationwide cost of ancillary services is about $12 billion a year, roughly 10% of the cost of the energy commodity. More important than the cost, however, is the necessity of these services for bulk-power reliability and for the support of commercial transactions. FERC's landmark Order 888 included a pro forma tariff with provision for six key ancillary services. The Interconnected Operations Services Working Group identified another six services that it felt were essential to the operation of bulk-power systems. Several groups throughput the United States have created or are forming independent system operators, which will be responsible for reliability and commerce. To date, the electricity industry (including traditional vertically integrated utilities, distribution utilities, power markets and brokers, customers, and state and federal regulators) has paid insufficient attention to these services. Although the industry had made substantial progress in identifying and defining the key services, much remains to be doe to specify methods to measure the production, delivery, and consumption of these services; to identify the costs and cost-allocation factors for these services; and to develop market and operating rules for their provision and pricing. Developing metrics, determining costs, and setting pricing rules are important because most of these ancillary services are produced by the same pieces of equipment that produce the basic electricity commodity. Thus, the production of energy and ancillary services is highly interactive, sometimes complementary and sometimes competing. In contrast to today's typical time-invariant, embedded-cost prices, competitive prices for ancillary services would vary with system loads and spot prices for energy.

The internal energy market is made up of the European gas and electricity markets. It has been the subject of several successive sets of directives and regulations, grouped into “legislative packages”. There have been three such packages up to now, put together by the European Parliament and the European Union Council, which establish common rules for the internal energy market for all Member States. In 2007, the European Commission drew up an assessment report on the internal market based on a sector-specific survey of the gas and electricity markets. It concluded that there were still numerous deficiencies preventing both consumers and the industry from fully reaping the benefits of open national markets. The Commission then announced that a 3rd legislative package would be introduced to reinforce the rules so far adopted. The aim of 3rd Energy Package which was adopted in 2009 was to make the energy market fully effective and to create a single EU gas and electricity market. This would help to keep prices as low as possible and increase standards of service and security of supply. The most important proposal of the "3rd Energy Package" is "ownership unbundling" - separating the operation of gas pipelines and electricity networks from the business of providing gas or generating power. The purpose of ownership unbundling is to promote an open and transparent market, non-discriminatory access to networks and a level playing field. The idea is to combat cross-subsidization between generation/supply and networks, including exchange of strategic information, to ensure both undistorted competition in electricity and gas markets and sufficient investment in networks. Therefore, in order to value the importance of the Third energy package for ensuring effective competition the principles of ownership unbundling should be precisely discussed. Thus in the first part of this paper general information about Third Energy Package will be given and brief description of principles, benefits and deficits of the ownership unbundling will be discussed in the following parts respectively. The conclusion part answers the question whether existence of the ownership unbundling, as a main part of the 3rd Energy Package is sufficient to ensure effective competition or not.

Non-discriminatory third-party access to transportation infrastructures in electricity - transmission and distribution networks - is essential for open and effective competition in wholesale and retail electricity markets. Competition in wholesale energy markets is possible and desirable as it will lead to lower prices, increase innovation, improve the quality of the service, foster investment in energy infrastructure, and promote renewable energy sources. However, transmission assets are generally considered natural monopolies as they are not economically duplicable. Because of their 'bottleneck' nature and their essentiality to transport electricity from generators to end consumers, network owners may use them anticompetitively. For instance, by denying access to other generators to their transmission infrastructure, grant access in discriminatory terms to exclude them (horizontal foreclosure), and/or exert vertical market power vis-à-vis buyers and consumers of electricity (downstream exploitation). To mitigate these competition risks, it is necessary to grant access to transmission networks to all electricity generators on a non-discriminatory basis through open access tariffs authorised and overseen by energy regulators. Nonetheless, third party access (“TPA”) alone is insufficient. TPA must be made effective in order to promote and protect competition in electricity and gas markets. This is done by imposing rules regarding the 'unbundling': the functional, control or structural-based separation of the generation and/or supply assets from the physical transmission or distribution networks. In this paper I analyse how the law in the US and the EU has addressed the problems stemming from the control over transmission networks through imposing a requirement for unbundled and non-discriminatory access to electricity transmission networks through regulatory and antitrust rules. Specifically, I compare and discuss the legal measures which have imposed TPA and the different unbundling models. The contribution shows that both regimes have pursued a similar policy concerning TPA and to a large degree unbundling mechanisms. Two differences are significant, however. First, the concomitant application of antitrust law to industries under the scope of sectoral regulation. Second, the preferred unbundling method: resorting either to structural forms requiring the divestiture of a vertically integrated undertaking (“VIU”) that owned transmission and generation assets, or instead allowing companies to remain vertically integrated, separating transmission operations from generation through functional or control-based options.
