The book delineates, with extraordinary clarity and precision, the working of unfair competition law throughout the European Union. Its four comprehensive chapters encompass: basic considerations of definition, subject matter, enforcement, and applicable law: international provisions under the Paris convention, TRIPS, and WIPO model law; analysis of relevant EC directives and regulations and ECJ jurisprudence; and extensive discussions of the national unfair competition laws of all 25 Member States. For each Member State, specific topics covered include such considerations as the following: sources of law; competition law in a nutshell; regulation of advertising; direct marketing; sales promotion; risk of confusion; disparagement, defamation; misappropriation, imitation; impediment of competitors; and breach of the law. The author also provides a selected bibliography of sources for each country. It would be difficult to find a more useful analysis of European Unfair Competition Law than this systematic study. It is practical, thorough, clarifying, and readable, all at the same time. The author untangles the most complex of apparent contradictions with impressive skill. Copies of this book will quickly take their places on the working shelves of interested practitioners, academics, and officials throughout Europe.

This work gives an overview of the current state of the law of unfair competition for the protection of the intellectual creations and industrial assets in the EU, the USA and other major Anglo-American jurisdictions. Despite the growing interest in this area of law in recent years, littleattention has been given to the varying legal and economic paradigms that underlie and shape it. This need for a comparative, theoretical examination is heightened by the advent of the information age, coupled with the desire to integrate markets. These developments pose a challenge to the currentregimes of intellectual property protection since these are increasingly becoming out of step with the paradigms that shaped the traditional patent, copyright and trademark regimes. In this work, the author explores the alternative to a protective regime based on unfair competition doctrines, andexamines the themes of economic justification, shaping legal boundaries, finding a legal justification, practical application, and harmonization of national laws.

Excerpt from Efforts to Define Unfair Competition The prohibition of unfair practices is further extended by various sections of the Clayton anti-trust Act. Sec. 2 of this act declares it unlawful for any person engaged in commerce to discriminate in price between different purchasers of commodities sold for use, consumption, or resale within the juris diction of the United States, where the effect of such discrimination may substantially lessen competition or tend to create a monopoly and that nothing shall prevent discriminations in prices made on account of differences in the cost of selling or transportation, or in order to meet competition, in good faith, and, with the further proviso that this shall not prevent persons from selecting their own customers in bona fide transactions not in restraint of trade. Sec. 3 declares it unlawful for any person engaged in commerce to lease or sell commodities, patented or unpatented, or to fix a price therefor or a discount from such price on the condition that the lessee or purchaser shall not deal in the commodities of a competitor, where the effect of the lease or sale may be to substantially lessen competition or tend to create a monopoly and that large corporations except banks and common carriers may not have common directors. Labor, agricultural or horticultural organizations are by a separate section excepted from these provisions.
