Daher weist nach dem Zeugnisse der Geschichte das Rechtsleben eines jeden Volkes, das einen selbstandigen Staat und eine selbst standige Gesellschaft gebildet hat, zu allen Zeiten ein eigen tumlich nationales Geprage auf. Hieraus folgt, dass die Gestaltung der Rechtsordnung auf nationalen Grundlagen die notwendige Bedingung der Befestigung der nationalen Selbstandigkeit bildet; denn eine gesunde nationale Entwicklung ist nur dort moglich, wo die innerlichen Elemente und Factoren des socialen Lebens in organischem Zusammenhange mit der sie regelnden ausseren Rechtsordnung stehen. Hieraus folgt ferner, dass so wie einer seits die erspriessliche Entwicklung des Rechts nicht anders gewartigt werden kann, als wenn der nationalen Individualitat und Eigenart bei den Neuerungen in richtigem Masse Rechnung getragen wird, andererseits auch in der literarischen Pflege der Rechtswissenschaft und auf dem Gebiete des Rechtsunterrichts die selbstandig nationale. This book—the first of a three-volume overview of comparative and transnational historiography in Europe—focuses on the complex engagement of various comparative methodological approaches with different transnational and supranational frameworks. It considers scales from universal history to meso-regional (i.e. Balkans, Central Europe, etc.) perspectives. In the form of a reader, it displays 18 historical studies written between 1900 and 1943. The collection starts with the French and German methodological discussions around the turn of the twentieth century, stemming from the effort to integrate history with other emerging social sciences on a comparative methodological basis. The volume then turns to the question of structural and institutional comparisons, revisiting various historiographical ventures that tried to sketch out a broader (regional or European-level) interpretative framework to assess the legal systems, patterns of agrarian production, and the common ethnographic and sociocultural features. In the third part, a number of texts are presented, which put forward a supra-national research framework as an antidote to national exclusivism. While in Western Europe the most obvious such framework was pan-European, in East Central Europe the agenda of comparison was linked usually to a meso-regional framework. The studies are accompanied by short contextual introductions including biographical information on the respective authors.

Hunderttausende Deutsche verlieaen im 18. Jahrhundert ihre Heimat. Insbesondere aus dem deutschen Sudwesten zog ein groaer Teil der Auswanderer in das historische Ungarn. Es waren begehrte Siedler, die den dunn besiedelten, zuvor von den Turken eroberten Raum besiedeln sollten. Die Zeit war gunstig: Die Agrarkonjunktur erlebte ab dem zweiten Drittel des 18. Jahrhunderts einen Aufschwung. Neben den Habsburgern waren es ungarische Magnaten, die deutsche Siedler in ihren Grundherrschaften erfolgreich ansiedelten. Ein Beispiel hierfur ist die Herrschaft Boly bei Funfkirchen (Pecs). Was fur Motive hatten die Grafen und Fursten von Batthyany, Deutsche zu werben, zu welchen Bedingungen erfolgte die Ansiedlung? Doch daneben wird auch nach den Lebensformen der Ansiedler gefragt, es werden Familien- und Frauenschicksale vorgestellt. Schliealich geht es um Konsolidierungskonflikte und das Spannungsfeld zwischen Grundherren und Untertanen. Dabei scheut es der Autor nicht, einige in der Literatur gepflegte Stereotypen der Auswanderung nach Ungarn in Frage zu stellen.
