Sondervermögen, Eigenbetriebe) durch privatrechtlich organisierte Unternehmen ersetzt, und auch im Verwaltungsbereich der Kommunen wurden immer mehr öffentliche in privatrechtliche Organisationsformen umgewandelt.1 Daraus sind sowohl Privatrechtsunternehmen im alleinigen Besitz der öffentlichen Hand entstanden, als auch Mischformen - so genannte Public Private Partnerships - bei denen zu dem öffentlichen Eigner auch private Anteilseigner hinzukommen.2 Als Begründung für diese Vorgehensweise ist häufig das Argument des Effizienzvorteils zu finden.3 Der privatrechtliche Unternehmensbereich des Staates, der überwiegend kommunale Aufgaben erfüllt, unterliegt aber kaum einer parlamentarischen Steuerung und Kontrolle.4 Wenn der Staat in öffentlich-rechtlichen Organisationsformen handelt, gibt es Regel- und Kontrollmechanismen, die ausschließlich auf den Eigner öffentliche Hand ausgerichtet sind. Diese gelten aber nicht, wenn er in Privatrechtsform tätig ist. Außerdem kommt bei einer privaten Kapitalbeteiligung der immanente Konflikt zwischen der Erfüllung der öffentlichen Aufgabe einerseits und dem Gewinninteresse der privaten Eigner andererseits hinzu.5 Somit ist der Unternehmenskontrolle bei Privatunternehmen im Eigentum der öffentlichen Hand gesteigerte Aufmerksamkeit zu widmen. Es besteht die Gefahr, dass zum Teil bewusst Einbußen bei den Kontrollrechten hingenommen werden, da die Formprivatisierungen und die Beteiligung von Privaten durch den finanziellen Handlungsdruck der Politiker bestimmt werden.6 Die beteiligten Akteure können zu ihren eigenen Gunsten und auf Kosten der übrigen Bevölkerung handeln, wenn keine verantwortungsvol

The covenants commit all nations to guarantee that their citizens shall enjoy the traditional formal rights; but they likewise pledge governments to make those rights meaningful in the real world by providing social security and cultural recognition to every person. This new book provides a systematic defence of social democracy for our contemporary global age. The authors argue that the claims to legitimation implicit in democratic theory can be honored only by social democracy; libertarian democracies are defective in failing to protect their citizens adequately against social, economic, and environmental risks that only collective action can obviate. Ultimately, social democracy provides both a fairer and more stable social order. But can social democracy survive in a world characterized by pervasive processes of globalization? This book asserts that globalization need not undermine social democracy if it is harnessed by international associations and leavened by principles of cultural respect, toleration, and enlightenment.
