Um einen Überblick zu vermitteln, woher der Gedanke stammt, Kunst und die damit verbundene Rechte des Urhebers zu schützen, werden anfangs ein historischer Überblick zur Entwicklung des Urheberrechts gegeben und seine Wurzeln erläutert. Danach folgt eine Zusammenfassung über Sinn und Zweck des Urheberrechts. Für die gesellschaftliche und kulturelle Entwicklung eines Landes ist es von großer Bedeutung, seine Künstler zu schützen und ihnen „freies“ künstlerisches Schaffen zu ermöglichen. Nicht nur der Gedanke, dass Künstler durch ihr Wirken zum kulturellen Leben und zur Weiterentwicklung der Gesellschaft einen wichtigen Beitrag leisten, sondern auch der finanzielle Aspekt der Regelungen des Urheberrechts wird beleuchtet. Künstler sollen sich einerseits von ihrem Schaffen selbst erhalten können, andererseits sind Kunstwerke gerade dazu da, von der Gesellschaft interpretiert und rezipiert zu werden. Daher steht ein Interessensausgleich zwischen jenen des Künstlers und jenen der Allgemeinheit im ständigen Fokus des Urheberrechts.
