In 1937 the Supreme Court revolutionized American constitutionalism, sharply restricting the states' powers and expanding those of the national government. In following years the civil rights movement caused further change, challenging American life with its demands for equal rights under the Constitution and protection by the federal government. The Vietnam War expanded and then contracted presidential power. In 2001, attacks organized by followers of Osama bin Laden on American cities revived presidential power, leading to new challenges to America's constitutional heritage. This volume assembles the most important documents from American constitutional history from the depths of the Great Depression to the terrorist attacks on New York and Washington, D.C. on September 11, 2001. Through these important documents, American constitutional power can be seen surging and waning, but always responding to the drama of world events.

English summary: The articles in this Liber Amicorum for Peter Haberle are connected by his approach to the concept of constitution from the perspective of cultural studies. He is unique in the manner in which he succeeded in looking beyond the results of the Weimar constitutional theory in the scholarly debate based on the Basic Law and in interpreting the constitution and constitutional law as a cultural and culturally-based process. The diverse articles from German authors as well as authors from Greece, Italy, Switzerland, Spain, Portugal, Japan, Peru and Mexico focus on this world of ideas and give a clear impression of Peter Haberle's international significance and influence.

As much of the world turns its attention to questions of the role and even survival of the nation-state formation in an increasingly globalized world, the authors of this interdisciplinary volume shift the focus of the debate by examining various sites of social action where the nation-state is still in a formative stage even as it is increasingly under threat. Challenges to emergent nation-building arise both from within multi-ethnic "states" as well as from without, e.g., through pressure from international human rights organizations and the global capitalist marketplace. The authors demonstrate, too, that this betwixt and between situation is neither entirely new nor unique to the globalized world system; parallel tensions already existed between locals and migrants of regional trading networks before the European colonizers arrived on the scene to further complicate matters. Including micro level ethnographies, local histories and a macro-theoretical overview of the world-system, this volume directly engages with the complexities of globalization in marginal and troubled states, complexities that are themselves typically marginalized in debates all too often obsessed with the plight of the most powerful and developed nations.
