VwVfG oder der öffentlich - rechtliche Vertrag im Sinne der §§ 54 VwVfG, dass bessere Handlungsinstrument für die Wirtschaftsverwaltung von heute ist. Welches Instrument findet dabei bei den typischen Aufgaben der Wirtschaftsverwaltung Wirtschafsaufsicht, - lenkung, - förderung, -planung, - information und Wirtschaftspolitik am besten Anwendung? Wobei sich diese Arbeit hauptsächlich mit dem Bereich der Wirtschaftsaufsicht beschäftigen wird. Ein erster Schritt ist daher eine genaue Betrachtung beider Instrumente - ihrer wesentliche Merkmale und ihrer typischen Anwendungsgebiete. Doch auch ihre Stellung im juristischen System - darf dabei nicht außer Acht gelassen werden. Danach stellt sich die Frage, in welche Richtung die Entwicklung bei der Anwendung beider Instrumente in den letzten Jahren ging und welche Probleme sich bereits abgezeichnet haben oder aber auch in Zukunft erwartet werden können. Am Ende dieser Arbeit wird in einem Fazit die Frage geklärt, ob es überhaupt ein besseres Tool für die Wirtschaftsverwaltung geben kann. So ist es vorstellbar, dass beide Instrumente jeweils für sich und nur in einen bestimmten Anwendungsbereich zweckmäßig angewendet werden können. Auch erscheint es denkbar, dass vor ihrer Anwendung eine Vielzahl unterschiedlicher Faktoren Berücksichtigung finden müssen. Dies würde bedeuten, dass weder das eine noch das andere Handlungsinstrument pauschal bevorzugt werden kann. Die Wirtschaftsverwaltung wäre auf beide Instrumentarien in gleichem Umfang zur Durchsetzung ihrer Ziele und damit dem auch des Allgemeinwohls, angewiesen. Dabei hat der Gesetzgeber der Verwaltung verschiedene Handlungsformen zur Verfügung gestellt, zu denen auch der Verwaltungsakt und der öffentlich-rechtliche Vertrag gehören. Bei der Wahl der Handlungsform hat die Behörde in der Regel eine freie Entscheidung, weshalb sich nun die Frage stellt, welchen Weg die Verwaltung bei ihrer täglichen Arbeit gehen soll. Daher sollen im Folgenden die Grundstrukturen der beiden Möglichkeiten betrachtet werden, die später dazu dienen sollen, sie anhand der spezifischen Merkmale zu vergleichen und Vor- und Nachteile des jeweiligen Verfahrens herauszuarbeiten. Zunächst sollen jeweils die gesetzlichen Grundlagen und die dazugehörigen Verwahrensmerkmale betrachtet werden um anschließend deren Verwendbarkeit im Alltag entsprechend werten zu können. Dazu folgt eine kurze Betrachtung der Wirtschaftsverwaltung und deren Bedeutung, einschließlich einer kurzen Wertung der ihr zur Verfügung stehenden Handlungsmöglichkeiten. Schlussendlich soll anhand des Vergleichs das bessere "Tool" für die Wirtschaftsverwaltung erkannt werden, was die Aufgaben der Behörden am besten unterstützt.
