En la actualidad, el sector turístico está experimentando convulsos cambios pasando de ser un mercado regulado por la Administración Pública a una situación en la que han aparecido plataformas de internet que ejercen esta actividad de acuerdo únicamente con el criterio de prestación de un servicio de mediación prestado por plataformas colaborativas, entendido como un servicio de la sociedad de la información lo que implica una redefinición de roles de los agentes implicados de acuerdo con unos criterios también novedosos.Ciertamente, la rápida expansión de este modelo está causando incertidumbre en los actores reglados de la oferta turística y repercusiones negativas en la sostenibilidad del destino.Las plataformas virtuales están dando al traste con la planificación turística de las Administraciones Públicas, requisito necesario para asegurar la posibilidad del desarrollo a largo plazo y beneficio para la comunidad receptora, acercándonos al concepto de un turismo no sostenible.En este contexto de fuerte demanda turística, es decisivo incidir en la planificación y ordenación urbana con el fin de conciliar un turismo como motor del desarrollo económico y sostenibilidad de los destinos.Este trabajo, además de analizar el rol actual de las plataformas colaborativas en el ámbito del alojamiento, se realiza un análisis comparado de normativas vigentes en las distintas Comunidades Autónomas del país sobre alojamiento colaborativo desde la perspectiva de sostenibilidad turística (social, económica y ambiental).También se pone de relieve el principal problema que comporta este tipo de alojamiento colaborativo: las dificultades de las Administraciones Públicas para hacer cumplir las normas correspondientes tanto a las plataformas como a las viviendas de uso turístico, centrándonos en el papel que deben jugar las plataformas, las Administraciones Públicas y más concretamente la Inspección Turística.En el presente trabajo el lector podrá encontrar la normativa vigente en las distintas Comunidades Autónomas en torno al tema de nuestro país y también un exhaustivo y completo análisis de los problemas jurídicos inherentes a la proliferación de plataformas colaborativas en el ámbito del alojamiento turístico.

Las plataformas digitales están ocupando una posición central y determinante en el creciente flujo de relaciones jurídicas y comerciales que en torno a ellas se articulan. Servicios tradicionalmente considerados públicos se ofrecen también a través de plataformas, que dejan por ello una peculiar impronta en las relaciones con los usuarios. Si antes se identificaron y caracterizaron con rasgos precisos los llamados servicios en red, asistimos ahora a la eclosión de los servicios en plataforma. Los retos que se plantean a efectos regulatorios en ese nuevo entorno tecnológico son, fundamentalmente, dos: uno es mantener, o recomponer en su caso el cuadro de garantías del tráfico jurídico que resulta exigible por los sujetos diversos que entablan su relación a través de las plataformas; el otro, garantizar la adecuada atención a los intereses generales en juego. Requiere ello afrontar como primera cuestión la de la naturaleza misma de las plataformas: si se trata de proveedores de contenidos o son ellas mismas sujetos de intermediación, una cuestión, como otras que pueden plantearse, que no tiene una solución unívoca dada la variada tipología de plataformas, según reconoce la Unión Europea en sus primeras aproximaciones. También habrá de plantearse la naturaleza y alcance de una regulación pública, en atención a los intereses generales presentes, que habrá de encauzar con tino el natural impulso autorregulador del primer momento en el que estamos.

Tourism and Degrowth develops a conceptual framework and research agenda for exploring the relationship between tourism and degrowth. Rapid and uneven expansion of tourism as a response to the 2008 economic crisis has proceeded in parallel with the rise of social discontent concerning so-called "overtourism." Meanwhile, despite decades of concerted global effort to achieve sustainable development, socioecological conflicts and inequality have rarely reversed, but in fact increased in many places. Degrowth, understood as both social theory and social movement, has emerged within the context of this global crisis. However, thus far the vibrant degrowth discussion has yet to engage systematically with the tourism industry in particular, while, by the same token, tourism research has largely neglected explicit discussion of degrowth. This volume brings the two discussions together to interrogate their complementarity. Identifying a growth imperative in the basic structure of the capitalist economy, the contributors contend that mounting critique of overtourism can be understood as a structural response to the ravages of capitalist development more broadly. Debate concerning overtourism thus offers a valuable opportunity to re-politicise discussion of tourism development generally. Exploring of the potential for degrowth to facilitate a truly sustainable tourism, Tourism and Degrowth will be of great interest to scholars of tourism, environmental sustainability and development.
