This book is the product of a series of reflections by career counseling and guidance specialists on a question central to society: "How can career and life design interventions contribute to fair and sustainable development and to the implementation of decent work all over the world? ". This question was formulated by Professor J. Guichard, the director of the UNESCO Chair in Lifelong Guidance and counseling at the University of Wroclaw, Poland. The researchers involved in this Chair’s activities proposed answers which form the chapters of this book. The observation that mater semper certa est remains accurate under most legal systems in the world. Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive family law, or at least to recognize the effects of foreign law and procedures (a kind of “procreative tourism”), appear nowadays also in states generally prohibiting surrogate motherhood. The issues discussed in this volume concern both national law and international court cases. Recent examples include the opinion of the European Court of Human Rights of 10 April 2019 initiated by the French Cour de cassation, the judgement of the German Bundesgerichtshofof 20 March 2019, and dilemmas of Polish administrative courts. Focusing on the international perspective, the present volume as well as an accompanying book in Polish are the results of the international cooperation of over 30 experts from both member states and observer states of the Council of Europe. The monograph is structured “from the general to the detail” and includes a comprehensive view as well: from the issues of philosophy and sociology of law, to human rights standards of national constitutions and international agreements, to principles of ordre public of forum and their protection with measures of private, public, and penal law. This allows readers, including legislators and judges, the better understanding of the fundamental legal problems that surrogate motherhood brings, both in states where law creates them in a narrower or wider extent, and in other countries of the world, to which these problems can be imported with the movement of people and with de lege lata and de lege ferenda postulates.

Naturalnie nie przynoszą jednoznacznej odpowiedzi, dlaczego wydarzenia potoczyły się wówczas w znany nam wszystkim sposób. Zwracają jednak uwagę na wiele czynników, które musiały prowadzić do ostatecznej katastrofy Napoleona, a co za tym idzie, rozpadu jego europejskiego imperium. Badania dotyczące wojny 1812 roku, najbardziej kontrowersyjnego konfliktu tej epoki, będą kontynuowane bez wątpienia także w przyszłości, chociaż historycy są świadomi, że na niektóre pytania trudno będzie udzielić jednoznacznej odpowiedzi. Niniejszy tom ma na celu przybliżyć Czytelnikowi wybrane problemy 1812 roku, zarówno w wymiarze politycznym, jak i prawnym, ekonomicznym, wojskowym, a wreszcie z perspektywy uczestników wydarzeń. Domestic work has become highly relevant on a local and global scale. Until a decade ago, domestic workers were rare in European households; today they can be found working for middle-class families and single people, for double or single parents as well as for the elderly. Performing the three C's - cleaning, caring and cooking - domestic workers offer their woman power on a global market which Europe has become part of. This global market is now considered the largest labour market for women world wide and it has triggered the feminization of migration. This volume brings together contributions by European and US based researchers to look at the connection between migration and domestic work on an empirical and theoretical level. The contributors elaborate on the phenomenon of 'domestic work' in late modern societies by discussing different methodological and theoretical approaches in an interdisciplinary setting. The volume also looks at the gendered aspects of domestic work; it asks why the re-introduction of domestic workers in European households has become so popular and will argue that this phenomenon is challenging gender theories. Książka stanowi studium teorii problemów społecznych wraz z empiryczną aplikacją. Wskazuje na sposób połączenia socjologii teoretycznej i stosowanej. Praca składa się z dwóch części, z których pierwsza zawiera analizę miejsca pojęcia „problem społeczny” i kontekstów, w których było używane w przeszłości i obecnie. Znaczna część książki dotyczy prezentacji konstrukcjonizmu społecznego w socjologii amerykańskiej jako teorii problemów społecznych. Podejście to zdominowano myślenia o trudnych kwestiach życia zbiorowego w czasie ostatnich trzydziestu lat. Autor zwrócił uwagę na związki między socjologią a pracą socjalną, ze szczególnym uwzględnieniem podejścia skoncentrowanego na rozwiązaniach (Solution Focused Approach). Druga część książki to opracowanie empiryczne, które opracowania odnosi się do „drugiej fali bezrobocia” w Polsce. Wykorzystując odmienne perspektywy teoretyczne, omówione w pierwszej części pracy, autor analizuje przyczyny, warunki, skutki i rozwiązania problemu kryzysu rynku pracy w latach 1999-2003 w kategoriach obiektywistycznych i subiektywistycznych. Praca traktuje o najważniejszych problemach stojących przez współczesnym społeczeństwem polskim. Zdecydowana większość sondaży opinii publicznej w ostatnich 15 latach pokazywała wagę kwestii zatrudnienia dla Polaków. Książka łączy nieszablonowe podejście do tematu cyklicznych trudności na rynku pracy w gospodarce kapitalistycznej oraz dorobek teoretyczny socjologii stosowanej i pracy socjalnej.
