Gegenstand der Abhandlung ist die umfassende Darstellung des § 1611 BGB. Diese Einwendung gegen den Unterhaltsanspruch Verwandter erlebte nach einer jahrzehntelangen Phase seltener Anwendung in den letzten Jahren einen Boom, der eine genaue Beleuchtung der Norm notwendig werden ließ. -- Neben einem Abriss der Historie der Norm bildet die ausführliche Behandlung ihrer geltenden Fassung seit dem NeheIG von 1969 den Schwerpunkt. In ständiger Rückführung auf die legislativen Ziele werden ihre Tatbestände und Rechtsfolgen systematisch dargestellt sowie Literatur und Judikatur ausgewertet. Es wird die Übertragbarkeit der umfassenden Judikatur zu § 1579 BGB detailliert erörtert und weitere denkbare Fallgruppen zu § 1611 entwickelt. Im Anschluss daran werden die Absätze 2 und 3, das Minderjährigenprivileg sowie die Fernwirkung gegenüber anderen Pflichtigen behandelt. Raum nehmen weiter das Verhältnis der Norm zu anderen Regelungskomplexen, etwa dem BSHG, ihr rechtstechnischer Charakter, Fragen der Beweislast sowie die Besonderheiten ihrer prozessualen Behandlung ein. -- Nach der Entwicklung eines Anwendungsschemas für die einzelnen Konstellationen werden abschließend in Rückführung auf den Anstoß zu dieser Arbeit die Gründe des Rechtsprechungsschubes auf die veränderte gesellschaftliche und familiäre Realität zurückgeführt und daraus eine Prognose für die weitere Entwicklung erstellt. -- Mit diesem Werk schließt die Autorin eine Literaturlücke. Es ist wegen seiner systematischen und praktischen Darstellung für Theoretiker und Praktiker gleichermaßen geeignet.

Despite the international community’s recognition of social protection as a human right, the vast majority of the world’s population still has no access to social protection. In a major effort to address this situation, the International Labour Conference unanimously adopted the Social Protection Floors Recommendation 202 of 2012. However, because of the wide variety of possible schemes (and techniques that can be employed to administer them), there is a genuine risk that important values relating to social protection will be overlooked in implementing the Recommendation. This collection of expert essays contains an in-depth clarification and analysis of the Recommendation and sets forth a clear and practicable set of principles that can be used both as a policy tool and as an assessment framework for the creation, maintenance, and supervision of a national social protection floor. As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justice system. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated. It offers a unique perspective that is likely to become a significant reference point for the ever-growing debates about the power of algorithms in daily life in the worlds of research, policy and practice.
