The production of crude oil and natural gas from unconventional reservoirs has become a growth sector within the North American energy industry, and current projections indicate that the production of some of these unconventional fossil fuels will continue accelerating in the foreseeable future. This shift in the energy industry has been accompanied by rising concerns over potential impacts on water resources because producing these fuels is thought to require more water per unit of energy produced than conventional sources and may lead to greater degradation of water quality. In this paper, we address these emerging environmental issues by (a) providing a comprehensive overview of the existing literature on the water quantity and quality implications of producing the main unconventional fossil fuels in North America and (b) characterizing the differences in social costs that arise from the extraction and production of these fuels versus those from conventional fossil fuel production.

This book addresses the need for deeper understanding of regulatory and policy regimes around the world in relation to the use of water for the production of ‘unconventional’ hydrocarbons, including shale gas, coal bed methane and tight oil, through hydraulic fracturing. Legal, policy, political and regulatory issues surrounding the use of water for hydraulic fracturing are present at every stage of operations. Operators and regulators must understand the legal, political and hydrological contexts of their surroundings, procure water for use in the fracturing and extraction processes, gain community cooperation or confront social resistance around water, collect flow back and produced water, and dispose of these wastewaters safely. By analysing and comparing different approaches to these issues from around the globe, this volume gleans insights into how policy, best practices and regulation may be developed to advance the interests of all stakeholders. While it is not always possible to easily transfer ‘good practice’ from one place to another, there is value in examining and understanding the components of different legal and regulatory regimes, as these may assist in the development of better regulatory law and policy for the rapidly growing unconventional energy sector. The book takes an interdisciplinary approach and includes chapters looking at water-energy nexus security in general, along with issue-focused and geographically-focused case studies written by scholars from around the world. Chapter topics, organized in conjunction with the stage of the shale gas production process upon which they touch, include the implications of hydraulic fracturing for agriculture, municipalities, and other stakeholders competing for water supplies; public opinion regarding use of water for hydraulic fracturing; potential conflicts between hydraulic fracturing and water as a human right; prevention of induced seismic activity, and the disposal or recycling of produced water. Several chapters also discuss implications of unconventional energy production for indigenous communities, particularly as regards sustainable water management. This volume will be of interest to scholars and students of energy and water, regulators and policymakers and operators interested in ensuring that they align with emergent best global practice.

The United States has seen resurgence in petroleum production, mainly driven by technology improvements-especially hydraulic fracturing and directional drilling-developed for natural gas production from shale formations. Application of these technologies enabled natural gas to be economically produced from shale and other unconventional formations, and contributed to the United States becoming the world's largest natural gas producer in 2009. Use of these technologies has also contributed to the rise in U.S. oil production over the last few years. In 2009, annual oil production increased over 2008, the first annual rise since 1991, and has continued to increase each year since. Between January 2008 and May 2014, U.S. monthly crude oil production rose by 3.2 million barrels per day, with about 85% of the increase coming from shale and related tight oil formations in Texas and North Dakota. Other tight oil plays are also being developed, helping raise the prospect of energy independence, especially for North America. The rapid expansion of tight oil and shale gas extraction using high-volume hydraulic fracturing has raised concerns about its potential environmental and health impacts. These concerns include potential direct impacts to groundwater and surface water quality, water supplies, and air quality. In addition, some have raised concerns about potential long-term and indirect impacts from reliance on fossil fuels and resulting greenhouse gas emissions and influence on broader energy economics. This report focuses mainly on actions related to controlling potential direct impacts. States are the primary regulators of oil and gas production on non-federal lands. State laws and regulations governing oil and gas production have been evolving across the states in response to changes in production practices as producers have expanded into tight oil, shale gas, and other unconventional hydrocarbon formations. However, state rules vary considerably, leading to calls for more federal oversight of unconventional oil and gas extraction activities, and hydraulic fracturing specifically. Although provisions of several federal environmental laws can apply to certain activities related to oil and gas production, proposals to expand federal regulation in this area have been highly controversial. Some advocates of a larger federal role point to a wide range of differences among state regulatory regimes, and argue that a national framework is needed to ensure a consistent minimum level of protection for surface and groundwater resources, and air quality. Others argue against more federal involvement, and point to the long-established state oil and natural gas regulatory programs, regional differences in geology and water resources, and concern over regulatory redundancy. The federal role in regulating oil and gas extraction activities-and hydraulic fracturing, in particular-has been the subject of considerable debate and legislative proposals for several years, but legislation has not been enacted. While congressional debate has continued, the Administration has pursued a number of regulatory initiatives related to unconventional oil and gas development under existing statutory authorities.

Shale oil and shale gas resources and the technology associated with their production are often termed "unconventional" because the oil and gas trapped inside the shale or other low-permeability rock formation cannot be extracted using conventional technologies. Since about 2005, the application of these technologies to fields in the U.S. have helped produce natural gas and oil in volumes that allowed the country to reduce its crude oil imports by more than 50% and to become a net natural gas exporter. The regional and national economic and energy advances gained through production and use of these resources have been accompanied, however, by rapid expansion of the infrastructure associated with the development of these fields and public concern over the impacts to surface- and groundwater, air, land, and communities where the resources are extracted. The intent of the first day of the workshop of the National Academies of Sciences, Engineering, and Medicine's Roundtable on Unconventional Hydrocarbon Development was to discuss onshore unconventional hydrocarbon development in the context of potential environmental impacts and the ways in which the risks of these kinds of impacts can be managed. Specifically, the workshop sought to examine the lifecycle development of these fields, including decommissioning and reclamation of wells and related surface and pipeline infrastructure, and the approaches from industry practice, scientific research, and regulation that could help to ensure management of the operations in ways that minimize impacts to the environment throughout their active lifetimes and after operations have ceased. This publication summarizes the presentations and discussions from the workshop.

The Energy and Water Development and Related Agencies Appropriations Act, 2010, which was included in the final legislation (H.R. 3183, Public Law 111-85), directed the U. S. Department of Energy (DOE) to develop this report outlining domestic unconventional fossil energy resource opportunities and associated technology applications, in support of overall research, development, and deployment (RD&D) strategy for the further development of these resources. While the strategy report is prepared by DOE, the scope of the RD&D opportunities and associated technology application is nationwide. Based on the current state of ongoing private and public research efforts, the report summarizes: the potential magnitude of the resource base for each of the unconventional fossil energy sources; the technical, safety, and environmental challenges that have been identified in connection with each of the unconventional resources; and the current status of research activity, both public and private, focused on these resources. From this review of past research activity, the report identifies the following principal remaining technological and environmental challenges: production of residual oil that remains in large domestic oil reservoirs while simultaneously storing carbon dioxide (CO2) in those same reservoirs; potential development of the nation's unmineable coal resource via underground coal gasification; the producibility of natural gas from methane hydrate and the potential for simultaneously sequestering CO2; development of gas shale and tight gas sands; application of advance computational methods for evaluating cumulative environmental and socioeconomic impacts of simultaneous development of conventional and unconventional resources on a regional basis; collection and archiving of historical baseline data related to unconventional fossil fuel resources that may facilitate collaborative efforts among researchers; and quantifying the environmental and safety impacts of unconventional resource development and identifying ways to reduce and/or mitigate these impacts, thereby improving environmentally sustainable production of the resources.

The ability to access and economically develop vast amounts of America’s unconventional natural gas resources, especially large shale gas formations, has altered our national view on energy and has subsequently changed the discourse at the federal, state, and local levels. Since 2008, when the economic viability of shale gas resources first became widely recognized, policymakers and industry leaders have worked to better understand the nature of this resource; the risks and opportunities associated with its production, transport, and use; and the potential strategic implications of the United States’ new energy reality. The paradox of the U.S. unconventional gas story is that the technologies and industry practices that made it possible have been decades in the making; the public policy and commercial landscape is vastly different from just a few years ago; and the story of this remarkable resource development is still in its infancy. In an attempt to capture the current state of play with respect to resource development, operational practices, risk identification and mitigation, impacts assessment and identify strategies that allow this valuable resource to be prudently developed, the CSIS Energy and National Security Program undertook this Unconventional Gas Initiative. Over the course of the past year, the authors were able—in concert with industry and nongovernmental organization (NGO) supporters—to work with a wide array of regulators, policymakers, environmental, industry and financial groups, academics and community stakeholders to capture the latest understanding of the unconventional gas development picture and develop themes and findings in the hope of facilitating an informed discussion on a path forward.
