In meinem Gutachten aus dem Jahre 1963, das ich über die Entwick lung des Gesellschaftsrechtes unter dem Gesichtspunkt der Europäischen Integration dem Zweiten Österreichischen Juristen-Tag zu erstatten hatte, war ein eigenes Kapitel dem Konzentrationsprozeß gewidmet, weil dessen Ende noch nicht abzusehen war. Die Kommission hatte 'Sich in dem Memoran dum über das Aktionsprogramm der EWG für die 2. Stufe vom 24. 10. 1962 nicht nur für eine Mißbrauchsaufsicht über bereits bestehende marktbeherr schende Unternehmen ausgesprochen, sondern auch gegen die künstliche Förderung volkswirtschaftlich nicht gerechtfertigter Unternernnenskonzen tration. Die sich seither noch weiter verstärkende Konzentrationsbewegung in der westlichen Welt hat gelehrt, daß diese Entwicklung tatsächlich größter Aufmerksamkeit bedarf, aber auch ruhiger sachlicher Betrachtung. Die Bu sionskontrolle steht auf der Tagesordnung. Ich hatte aufmerksam gemacht, daß sich im Welthandel die inländischen Unternehmen den mächtigen Kon kurrenten des Auslandes gegenüber sehen, denen sie ebenbürtig zu werden trachten müssen, wollen sie auf Dauer bestehen; die jeweils größte Erzeu gung, die im Wettbewerb steht, ist maßgebend. Die kleine österreichische Autoerzeugung steht z. B. dem gigantischen General Motors-Konzern gegen über mit über 750. 000 Arbeitnehmern, einem Einsatz von rund 300 Milliar den Schilling Eigenmitteln und einem Jahresumsatz von über 600 Milliar den Schilling. Ähnliche Beispiele ließen sich für die BRD und die Schweiz geben. An solchen Zahlen kann man nicht einfach vorübergehen. Bei dem angestrebten freien Wettbewerb mit dem Ausland muß daher die ausländi sche Entwicklung ständig beobachtet werden.

For many businesses, mediation is seen as a swifter and cost-effective alternative to conventional forms of dispute resolution. Although its acceptance by policymakers in Europe has been slow, the recent development by various EU Member States of legal and institutional frameworks for commercial mediation have been complemented by a European framework for cross-border civil and commercial mediation, the EU Directive on Certain Aspects of Mediation in Civil and Commercial Matters. This extraordinary book, the first thorough analysis of the current state of commercial mediation practice in Europe, is based on face-to-face interviews and responses to questionnaires involving the participation of 25 renowned European mediators, with complementary contributions by 20 business people who have used mediation extensively. Among the areas of interest that arise are the following: typical areas of application of commercial mediation; types of disputes where commercial mediation is most beneficial; reasons why companies opt for mediation; dispute stages at which mediation may be most useful; length of the mediation process; costs of the process; likely causes of the considerable guardedness of enterprises against mediation; the role lawyers play as gatekeepers; the power factor and other imbalances; the role of provider agencies; and various approaches to mediation style. Participants have been chosen from Austria, Germany, France, England, Scotland, Denmark, Norway, Sweden and Finland, with the aim of including all the dominant European legal traditions. There are numerous case studies, including the role of mediation in such major projects as the Vienna Airport, the Eurotunnel, and the Øresund link bridge. Since the 1960s the environment has become an issue of increasing public concern in North America and elsewhere. Triggered by the Second Indochina War (Vietnam Conflict) of 1961-1975, and further encouraged by the International Conference on the Human Environment, held in Stockholm in 1972, the environmental impact of war emerged and grew as a topic of research in the natural and the social sciences. And in the late 1980s this led additionally to a focus and debate on environmental security. Arthur Westing, a forest ecologist, was a major pioneer contributing and framing both of those debates conceptually, theoretically, and empirically, starting with Harvest of Death: Chemical Warfare in Vietnam and Cambodia (1972) (co-authored with wildlife biologist E.W. Pfeiffer and others). As a Senior Researcher at the Stockholm and Oslo International Peace Research Institutes (SIPRI and PRIO), and as a Professor of Ecology at Windham and Hampshire Colleges, Westing authored and edited books on Ecological Consequences of the Second Indochina War (1976), Weapons of Mass Destruction and the Environment (1977), Warfare in a Fragile World: Military Impact on the Human Environment (1980), Herbicides in War: the Long-term Ecological and Human Consequences (1984), Environmental Warfare: a Technical, Legal and Policy Appraisal (1984), Explosive Remnants of War: Mitigating the Environmental Effects (1985), Global Resources and International Conflict: Environmental Factors in Strategic Policy and Action (1986), Cultural Norms, War and the Environment (1988), Comprehensive Security for the Baltic: an Environmental Approach (1989), and Environmental Hazards of War: Releasing Dangerous Forces in an Industrialized World (1990) --- as well as authoring numerous UN reports, book chapters, and journal articles.
