The lack of clarifying the political intention behind the phrase "the best interest of the child" as the obligation for the child to be with both parents in almost all circumstances is causing some children serious harm, as well as some primary caretakers (mostly women). In the legal realm on parental responsibility, the missing specification or definition of "the best interest of the child" leads to a suppression of the child's need for care and protection. If child experts follow the two-parents-are-necessary line, children who are being stressed or hurt are the losers. In October 2013, the Committee on Petitions of the European Parliament approved a working document on a fact-finding visit to Denmark regarding child custody and visitation rights, stating that Denmark's Parental Responsibility Act has the possibility of creating perverse effects in cases with an abusive parent. By focusing on several different aspects of the law, illustrated by testimonies of high-conflict cases where the Act had severe and negative effects for children and their mothers, this book illustrates the problematic dynamics of the current Act. This collection, written by legal scholars from around the world, offers insights into a variety of topics from children’s rights to criminal law, jurisprudence, medical ethics and more. Its breadth reflects the fact that these are all elements of what can broadly be called ‘law and society’, that enterprise that is interested in law’s place or influence in diffferent aspects of real lives and understands law to be simultaneously symbol, philosophy and action. It also testament to the broad range of vision of Professor Michael Freeman, in whose honour the volume was conceived. The contributions are divided into categories which reflect his distinguished career and publications, over 85 books and countless articles, including pioneering work on children’s rights, domestic violence, religious law, jurisprudence, law and culture, family law and medicine, ethics and the law, as well as his enduring commitment to interdisciplinarity.

Human Rights In Child Protection written by Asgeir Falch-Eriksen and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005-01-01 with Child welfare categories.

This open access book critically explores what child protection policy and professional practice would mean if practice was grounded in human rights standards. This book inspires a new direction in child protection research – one that critically assesses child protection policy and professional practice with regard to human rights in general, and the rights of the child in particular. Each chapter author seeks to approach the rights of the child from their own academic field of interest and through a comparative lens, making the research relevant across nation-state practices. The book is split into five parts to focus on the most important aspects of child protection. The first part explains the origins, aim, and scope of the book; the second part explores aspects of professionalism and organization through law and policy; and the third part discusses several key issues in child protection and professional practice in depth. The fourth part discusses selected areas of importance to child protection practices (low-impact in-house measures, public care in residential care and foster care respectively) and the fifth part provides an analytical summary of the book. Overall, it contributes to the present need for a more comprehensive academic debate regarding the rights of the child, and the supranational perspective this brings to child protection policy and practice across and within nation-states. .

The collection aims to inspire readers with new approaches to implementing and monitoring the United Nations Convention on the Rights of the Child, to make rights ‘real’ in children’s lives. Children’s human rights are internationally recognised in the legally binding international treaty—the UN Convention on the Rights of the Child, the most ratified of all human rights treaties. Although measures are increasingly being taken to implement the Convention at a national level, more needs to be done to ensure that children’s rights are recognised and supported in their daily lives. This collection brings together the latest research on new approaches to embedding children’s rights into national law and policies, with contributions from academics, practitioners and importantly young activists, from the UK and beyond. This book will be of interest to all human rights advocates, particularly policy makers and practitioners looking for new ways in which to make children’s rights real. The chapters in this book were originally published as a special issue of The International Journal of Human Rights.

The International Survey Of Family Law written by Andrew Bainham and has been published by Martinus Nijhoff Publishers this book supported file pdf, txt, epub, kindle and other format this book has been release on 1998-02-05 with Law categories.

The "International Survey of Family Law," published on behalf of the International Society of Family Law, is the successor to the Annual Survey of Family Law'. It provides information, analysis and comment on recent developments in Family Law across the world on a country-by- country basis. The "Survey" is published annually and its subtitle reflects the calendar year surveyed. Where a country has been regularly surveyed each year, the developments discussed correspond to the year in question. If certain countries have not been surveyed for some years the contributions will usually attempt to cover the intervening period. This applies, for example, in the present volume to the contributions relating to China and Turkey. If countries are being covered for the first time, then more background information will be provided about the state of family law in the country in question. The "Survey" also contains an article dealing with the more significant developments in international law affecting the family.
