This calls for a more inclusive public international law that accepts diverse actors in addition to States and other sources of law, including individualized voluntary commitments. Norms are critical to the stability and legitimacy of this international system. They underlie responses to rapid change, to new technological developments and to problems of protecting commons, promoting public goods, and providing social and economic justice. Certain fundamental norms can be identified ; others are emerging. The norm of mutual accountability underpins the implementation of other norms. Norms are especially relevant to frontier doit-yourself technologies, such as synthetic biology, digital currencies, cyber activity, and climate interventions, as addressed in the book. The persistent objector rule is said to provide states with an 'escape hatch' from the otherwise universal binding force of customary international law. It provides that if a state persistently objects to a newly emerging norm of customary international law during the formation of that norm, then the objecting state is exempt from the norm once it crystallises into law. The conceptual role of the rule may be interpreted as straightforward: to preserve the fundamentalist positivist notion that any norm of international law can only bind a state that has consented to be bound by it. In reality, however, numerous unanswered questions exist about the way that it works in practice. Through focused analysis of state practice, this monograph provides a detailed understanding of how the rule emerged and operates, how it should be conceptualised, and what its implications are for the binding nature of customary international law. It argues that the persistent objector rule ultimately has an important role to play in the mixture of consent and consensus that underpins international law.

Globalisation of the market, law and politics contributes to a diversity of transnational sustainability problems whose solutions exceed the territorial jurisdictional limits of nation states in which their effects are generated or occur. Winning the Peace seeks to explore and explain how Australian governments, during the modern period of Australia's engagement with Asia (from 1983 till today), have attempted to use their defence and foreign policies to shape the region. While there were certainly times of tension during this period, such as the spikes around the end of the Cold War and during the early years of the War on Terror, the region has been largely defined by peace. Because of this peace and thanks to Australia's relative size as a 'middle power', the government's attempt to change how other states act and think was not sought through the deployment or use of force but through military and diplomatic engagement and persuasion. Australia's smaller size also meant it had to be strategic in its efforts. It had to determine which changes were priorities, it had to re-organise and develop its resources, it had to deploy them effectively and efficiently, and it had to be able to sustain the effort in the face of competition and rejection. This book focuses on the three main 'campaigns' the Australian government has undertaken since the early 1980s to reshape the Asia-Pacific in pursuit of its national interests.
