The Working Time Directive was introduced in the EU in 1993, setting an average limit of 48 working hours over seven days for employees (and includes other measures such as establishing night work limits and entitlements to rest breaks and four weeks paid annual leave). The Directive was transposed into UK law by the Working Time Regulations 1998 which includes the right to a voluntary opt-out. The Committee's inquiry is designed to contribute to the review of the Directive currently being undertaken by the European Commission. Their conclusions include that the voluntary opt-out should be retained as it offers flexibility to employers and employees; and that more time is needed to work out a practical compromise regarding the working hours of on-call hospital doctors which protects standards of patient care without blocking medical training needs.

This report makes available the oral evidence provided by Pat McFadden MP to EU Sub-Committee G (Social Policy and Consumer Affairs) following the political agreements reached in Council on 9 June 2008 in relation to: amendments to the 2003 Working Time Directive; and a new directive on the working conditions of temporary agency workers. The Committee welcome the agreements reached in Council on 9 June on both these long-standing proposals. But as there is a requirement, under the co-decision procedure, to obtain the agreement of the European Parliament, the Committee urges the Government to argue energetically the case with MEPs for the merits of the texts agreed in Council.

In its Green Paper about the need for labour market reform, the European Commission argued that the increasing diversity of 21st century working relationships means that existing labour law is no longer adequate. This report brings together the evidence from a wide range f experts and representative bodies about these issues as they affect the UK labour market. It finds that the evidence does not support the Commission. The consensus is that the relatively light regulation of the UK labour market is advantageous and that problems of social disadvantage and structural unemployment are better addressed by measures aimed at tackling poor skills and social inequality rather than changing labour law. The report therefore recommends that efforts at EU level should focus on the promotion and sharing of good practice, rather than the introduction of new legislation.

The European Commission want to set up a European Institute for Gender Equality to collect and analyse data, carry out research and promote exchanges of information and good practice about gender issues in the EU. The European Union Committee expresses the view that a separate body of this kind is not needed, and that more consideration should be given to the case for incorporating gender equality work in the proposed European Fundamental Rights Agency. The Committee also states that the establishment of such a body requires a good management structure along with adequate funding. The Committee further states that the Government should take a clear and consistent line on the correct legal base for this and similar proposals.

In international tax law, the term ‘beneficial ownership’ refers to which parties involved in a cross-border transaction are entitled to tax treaty benefits. However, determining beneficial ownership is a complex and often disputed issue, subject to different meanings in different countries. Archival research on its early use in tax treaties and in the developing OECD Model reveals that its meaning has changed dramatically over the decades, leading to new interpretations significantly affecting current tax practice and scholarship. This book, dedicated to establishing how beneficial ownership should ideally be interpreted, compares the use and interpretation of benefi-cial ownership, both current and historical, in a wide range of national jurisdictions as well as the EU, ultimately shedding a clearer light than has heretofore been available on the meaning of the term.
