Das Wort ist in aller Munde, doch es fällt nicht leicht, sich mit Kultur wissenschaftlich auseinander zu setzen. Und allen Theorien voran sollte zunächst einmal eine klare Definition des Begriffs stehen. Doch der Begriff Kultur ist unscharf zusätzlich emphatisch besetzt; es ist nicht leicht, ihn zu fassen und sinnvoll einzugrenzen. Dieses Problem beschreibt auch der 1955 geborene Autor und Wissenschaftler Dirk Baecker in einem Artikel der Frankfurter Rundschau: „Kultur reicht von der Currywurst bis zu den Balletten Forsythes, von der Gewalttat bis zur wissenschaftlichen Glanzleistung, von den Tätowierungen der Maoris bis zu den Nadelstreifen der Top Manager.“1 Kultur wird als Begriff genauso gebraucht wie ein allgemein bekannter Alltagsgegenstand, den man nicht zu erläutern braucht. Die Aussage „das ist Kultur“ bedarf keiner Erklärung. Kultur spricht für sich und steht gewissermaßen auch unter einem Fragetabu.

The global movement of culture and religion has brought about a serious challenge to traditional constitutional secularism. This challenge comes in the form of a political and institutional struggle against secular constitutionalism, and a two pronged assault on the very legitimacy and viability of the concept. On the one hand, constitutional secularism has been attacked as inherently hostile rather than neutral toward religion; and, on the other hand, constitutional secularism has been criticized as inevitably favouring one religion (or set of religions) over others. The contributors to this book come from a variety of different disciplines including law, anthropology, history, philosophy and political theory. They provide accounts of, and explanations for, present predicaments; critiques of contemporary institutional, political and cultural arrangements, justifications and practices; and suggestions with a view to overcoming or circumventing several of the seemingly intractable or insurmountable current controversies and deadlocks. The book is separated in to five parts. Part I provides theoretical perspectives on the present day conflicts between secularism and religion. Part II focuses on the relationship between religion, secularism and the public sphere. Part III examines the nexus between religion, secularism and women's equality. This innovative study examines the authority constituting the European Union. It claims that the type of power constituting a transnational regime transcends traditional forms of constitutional legality. It argues that the European constitutional project is out of step with the normative make-up of such a regime. It is to be feared, indeed, that the adoption of a Constitution for Europe would create a smokescreen obscuring a new and disturbing reality. Drawing on the ancient tradition of linking different types of political power with the composition of the citizen's soul, the book explains that a transnational regime is based on an understanding of citizenship that is different from that underlying a constitutional democracy. Citizens are deemed to be essentially separate from one another. They abandon the larger society to itself and pursue their good in the private sphere. In place of trust and reliance in their own power to bring about change through common action, they hope to benefit from entrusting "problem-solving" to international networks of expertise. Essentially, citizens of this kind exhibit a strong commitment to individualism. The book shows how individualism is reflected in the regulatory authority that the Union claims for itself, in particular as regards the regulation of the internal market.
