Die durch die Verbandsmitgliedschaft vermittelte Tarifgebundenheit besteht nach dem Wortlaut des § 3 Abs. 3 TVG zeitlich unbegrenzt fort, bis der Tarifvertrag endet. Die dadurch aufrechterhaltene zwingende Tarifgeltung wird auf Arbeitgeberseite als erhebliche Beschränkung empfunden, wenn es sich um unbefristete, manchmal jahrelang nicht endende Tarifverträge handelt. In der Abhandlung wird untersucht, ob die fortbestehende Tarifgebundenheit in diesen Fällen zeitlich zu begrenzen ist. Dies wird nach einer Verhältnismäßigkeitsprüfung zur Auflösung der Grundrechtskollision zwischen dem durch § 3 Abs. 3 TVG bezweckten Arbeitnehmerschutz und der Vertragsfreiheit des Arbeitgebers (jeweils Art. 12 Abs. 1 GG) bejaht. Die zeitliche Grenze wird im Wege verfassungskonformer Auslegung bestimmt.

Der seit Mitte der 1990er Jahre zu verzeichnende Rückgang der Tarifbindung, der steigende Wettbewerbsdruck sowie die Wirtschaftskrise im Jahre 2008 stellen nunmehr das bislang sehr erfolgreiche Tarifsystem und seine Protagonisten vor neue Herausforderungen. Im Zentrum der Untersuchung steht die Frage der Verfassungsmäßigkeit von sehr kurzfristigen Beendigungsmöglichkeiten der tarifgebundenen Mitgliedschaft in Arbeitgeberverbänden. Wie muss ein Tarifsystem ausgestaltet sein, um einerseits die Bedürfnisse der in Verbänden organisierten Arbeitgeber hinreichend zu achten und andererseits die strukturelle Ungleichheit im Verhältnis zwischen Arbeitnehmer und Arbeitgeber durch die Gewerkschaften als Arbeitnehmervertretung zu berücksichtigen? Development aid has recently become an important part of international politics in general and Norwegian foreign policy in particular. This study explores the moral discourse of contemporary Norwegian development aid organisations and professional development workers. Adopting a discourse-analytical and multi-disciplinary approach, key concepts such as human rights, charity, justice and compassion are discussed.
