Studienarbeit aus dem Jahr 2009 im Fachbereich Politik - Thema: Völkerrecht und Menschenrechte, Note: 1,0, Universität Osnabrück (Institut für Migrationsforschung und Interkulturelle Studien (IMIS)), Sprache: Deutsch, Abstract: Die Debatte über Zwangsheirat und häusliche Gewalt in Migrantenfamilien wurde ausgelöst durch die bundesweite Kampagne der Frauenrechtsorganisation Terre des Femmes im Jahr 2003 unter dem Titel "Stoppt Zwangsheirat". Besonderen Nachdruck gewann die Diskussion aber durch die allgemein als Ehrenmord verstandene Bluttat an Hatun Aynur Sürücü am 7. Februar 2005 in Berlin. Auf politisch-rechtlicher Ebene gab es diesbezüglich eine lange Diskussion, welche auf die Anhebung des Nachzugsalters für Ehegatten von bisher 18 Jahren auf 21 Jahre zielte. Kritiker hielten die geplante Maßnahme zur Verhinderung von Zwangsehen nicht nur für wirkungslos, sie äußerten vielmehr verfassungsrechtliche Bedenken. Die Arbeit möchte einen Beitrag leisten zu einer differenzierteren Sichtweise des Phänomens der Zwangsverheiratung. In diesem Zusammenhang werden die Möglichkeiten rechtlicher Regelungen vor dem Hintergrund des aus den Grund- und Menschenrechten erwachsenden normativen Anspruchs in ihrem Für und Wider dargestellt. Daran anschließend skizziert der Autor die politische Auseinandersetzung zum Thema in ihrem Spannungs-verhältnis zu den genannten normativen Erwartungen und reflektiert die Frage der Fundierung des universalen Geltungsanspruchs der Menschenrechte. Ein weiterer Schritt fragt aus soziologischer Sicht nach einer Erklärung für die fortwährende Diskrepanz zwischen normativem Anspruch und politischer Handhabung. Die Ursache hierfür wird in der empirischen Unvereinbarkeit nationalstaatlicher Verfasstheit der Politik mit dem universalen Anspruch der Grund- und Menschenrechte identifiziert. Auf dieser Grundlage wird schließlich ein Fazit als Beitrag für weitere Diskussionen formuliert.
