El derecho penal internacional (dpi) no tiene una teoría coherente, pero sí sufre de al menos cuatro defectos bastante graves. Primero, como punto de partida, el concepto y significado de dpi en sus diferentes variaciones debe ser clarificado (‘la cuestión del concepto y significado’). Segundo, la cuestión de si y cómo puede existir el poder punitivo a nivel supranacional sin un soberano (‘la cuestión del ius puniendi’) debe ser respondida de manera satisfactoria. Tercero, la función o propósito global del dpi, en oposición al derecho penal nacional (‘la cuestión de la función global), debe ser explicada de manera más convincente. Cuarto, los fines de la pena en el dpi, en oposición a los fines tradicionales discutidos en el derecho penal nacional, deben ser elaborados (‘la cuestión de los fines de la pena’). Hay una relación en parte vertical y en parte horizontal entre estas cuestiones; por ejemplo, es imposible reflexionar sobre el ius puniendi, sobre la función global y sobre los fines de la pena sin haber clarificado primero el concepto de dpi. Además, un tratamiento de la función global y de los fines de la pena parece que tiene que basarse en la justificación del ius puniendi. En efecto, la falta de una respuesta satisfactoria a la cuestión del ius puniendi es, quizás, la debilidad teórica más importante del dpi actual. Por consiguiente, este trabajo pretende desarrollar una teoría coherente del dpi. En la primera parte se trata de resolver las dos primeras cuestiones, enfocando el aspecto del ius puniendi. En la segunda parte se analiza la tercera cuestión de la función (global) del dpi. Implícitamente se refiere también a la cuarta cuestión de los fines de la pena. Precio: 16.000 pesos

The modern prison is commonly thought to be the fruit of an Enlightenment penology that stressed man's ability to reform his soul. The Medieval Prison challenges this view by tracing the institution's emergence to a much earlier period beginning in the late thirteenth century, and in doing so provides a unique view of medieval prison life. G. Geltner carefully reconstructs life inside the walls of prisons in medieval Venice, Florence, Bologna, and elsewhere in Europe. He argues that many enduring features of the modern prison--including administration, finance, and the classification of inmates--were already developed by the end of the fourteenth century, and that incarceration as a formal punishment was far more widespread in this period than is often realized. Geltner likewise shows that inmates in medieval prisons, unlike their modern counterparts, enjoyed frequent contact with society at large. The prison typically stood in the heart of the medieval city, and inmates were not locked away but, rather, subjected to a more coercive version of ordinary life.
