l primer día que cualquier estudiante de Derecho pisa una Facultad, suelen ser varios los Profesores que le repiten aquello de ubi societas ibi ius, ergo ibi ius ibi societas. Toda colectividad, comunidad, sociedad, está regida por unas normas. Las normas, por tanto, rigen a las personas y se caracterizan por su efectividad en la realidad del día a día. Dichas normas deben ser complicadas de dominar, pues la experiencia demuestra que son muchos los estudiantes de Derecho que sufren para sacar la carrera. Sin embargo, pasados los años, muchos de ellos son buenos profesionales del Derecho, en muchos casos a pesar de haber tardado más de lo debido en sacar la carrera o tras haber tenido que recuperar más de una asignatura (algunas como Romano, Procesales y Mercantiles, ostentan el record de sobre- concentración de alumnos que se atascan en ellas). ¿A que se debe éste desajuste?, ¿por qué se sufre tanto entonces en la carrera si luego se es buen profesional y se llega a desempeñar un buen papel? En mi humilde opinión, ello viene determinado por dos factores: primero, porque no se cuida adecuadamente el sujeto, el estudiante, el joven jurista, el capital humano; y segundo, porque por unas cosas o por otras, no se llega a ubicar lo que se estudia en la realidad, lo cual contrasta con el hecho de que el Derecho se realice cada día en multitud de aplicaciones de las normas. A fin de ayudar a los estudiantes de Derecho, daremos unas brevísimas pistas en las páginas que siguen. Seguro que pueden encontrarse otras pistas más útiles y mejores en otros lugares. Quien esto escribe asume voluntariamente dos limitaciones: la propia, pues la juventud y las propias carencias no permiten más; y la del espacio, pues aunque se podrían decir muchas más cosas, he estimado que la brevedad dará más frutos a más gente, razón por la cual prescindiré de la extensión.
