We live in a world of science. Yet this is impossible without a legally guaranteed freedom to practise it. Findings with regard to the elements of such freedom can be deduced from an analysis of international and domestic provisions and principles. There are a plethora of international institutions, legal rules and global norms for the purpose of the international governance of science. The institutions and rules are to be interpreted in light of this freedom to guarantee the continuous existence of the knowledge-based society by means of a global administrative law of science. These aspects were analysed in a research project funded by the German Research Foundation. The book’s purpose is to present the jurisprudential results. In addition, empirical results are collected in a freely available database. The study is composed of 5 parts: The Concept of Science/Global Administrative Law/Constitutional Basis: The Freedom of Science/Institutional Design/Governance Mechanisms.

Durch ihre Stellung als unabhängige, aber dennoch regierungsnahe Institution hat sie aufgrund der mannigfachen Dialoge mit staatlichen Stellen und der Kooperation mit Nichtregierungsorganisationen (NGO) und der Zivilgesellschaft eine einzigartige Brückenfunktion, die eine große Chance für die Verständigung und Zusammenarbeit zwischen den einzelnen Akteuren auf staatlicher und nichtstaatlicher Ebene darstellt. Ihre normative Grundlage leitet die nationale MRI von dem durch die Vereinten Nationen geschaffenen unverbindlichen internationalen Standard, den sogenannten „Pariser Prinzipien“, ab. Diese Seminararbeit beleuchtet zunächst den historischen Rahmen hinsichtlich der Entwicklung dieses Standards sowie die darin allgemein für nationale MRI vorgeschlagenen Funktionen, Befugnisse und Strukturen. Erläutert wird auch das Prozedere der Anerkennung von nationalen MRI und die sich im Laufe der vergangenen Jahre entwickelte Realität von vier verschiedenen Institutionstypen. Im anschließenden Teil II wird anhand einiger Länderbeispiele kritisch aufgezeigt, inwieweit Unterschiede in der konkreten Ausgestaltung der einzelnen Institutionstypen bestehen. In diesem Kontext werden bestehende Mängel in der Umsetzung des internationalen Standards aufgezeigt und gegebenenfalls Anregungen für Verbesserungen gemacht. Im anschließenden Vergleich der verschiedenen Institutionstypen wird eine gewisse Hierarchie der Befugnisse und Wirkmächtigkeit deutlich; als Exkurs wird an dieser Stelle die Situation der nationalen MRI in Deutschland hinsichtlich eines möglichen oder notwendigen Typenwechsels diskutiert. In Teil III wird die Wirkmächtigkeit der nationalen MRI erläutert. Es wird aufgezeigt, inwiefern sich eine mangelhafte Umsetzung der „Pariser Prinzipien“ negativ auf die Wirkmächtigkeit der Institutionen auswirkt.

Over the past two decades new international courts have entered the scene of international law and existing institutions have started to play more significant roles. The present volume studies one particular dimension of their increasing practice: international judicial lawmaking. It observes that in a number of fields of international law, judicial institutions have become significant actors and shape the law through adjudication. The contributions in this volume set out to capture this phenomenon in principle, in particular detail, and with regard to a number of individual institutions. Specifically, the volume asks how international judicial lawmaking scores when it comes to democratic legitimation. It formulates this question as part of the broader quest for legitimate global governance and places it within the context of the research project on the exercise of international public authority at the Max Planck Institute for Comparative Public Law and International Law.

The concept of global governance, which first emerged in the social s- ences, has triggered different responses in the discipline of law. This volume contains our proposal. It approaches global governance from a public law perspective which is centered around the concept of inter- tional public authority and relies on international institutional law for the legal conceptualization of global governance phenomena. This proposal results from a larger project which started in 2007. The project is a collaborative effort of the directors of the Max Planck Ins- tute for Comparative Public Law and International Law, research f- lows and friends of the Institute, as well as eminent members of the Law Faculty of the University of Heidelberg. The book analyses how subsequent agreements and subsequent practice as defined in articles 31 and 32 of the 1969 Vienna Convention on the Law of Treaties have been applied in interpretative reality. Based on the jurisprudence of domestic courts, it elucidates the distribution of power between the parties to a treaty and other actors. To start with, the book traces the origins of subsequent agreements and subsequent practice and places them in their broader legal context. Next, it explores the legal status and effects of subsequent agreements and subsequent practice, explains why such agreements are only rarely used, and defines the relevance of non-party practice in the interpretative process. In closing, it critically examines how domestic courts have approached the normative heart of subsequent practice, i.e. the notion of ‘agreement’. Thus, this book ultimately challenges the traditional assumption that the parties are the joint masters of the treaty.

The Ludwig Maximilians University of Munich and the Humboldt University of Berlin are happy that you have followed our invitation. We are particularly proud that a majority of the members of the Int- national Law Commission have accepted our invitation. The presence of one former member of the Commission deserves special mention: Bruno Simma is now not only a Judge at the International Court of J- tice but also, if I may say so, the “local hero”, having held the wond- ful Chair for International Law at the University of Munich for more than thirty years. He is still living in Munich when he is not in The Hague. We are glad that participants have come from nearby, from neighbouring regions and countries, as well as from countries as far away as Brazil and China. I am personally very content that our group represents a fine mixture of experienced international lawyers and younger colleagues and students. This composition gives us the opp- tunity for fruitful exchanges, and for the ILC to reach out and to - ceive feedback. The International Law Commission needs no introduction. Like a few happy persons, at age sixty it can look back onto a largely successful - reer.
