This volume is the first of two addressing the legal regime governing the use of force during armed conflicts. Traditionally labeled 'Hague Law', today the norms it examines are commonly referred to as 'conduct of hostilities rules'. At the heart of this body of law is the principle of distinction, which requires that civilians and civilian objects be distinguished from combatants and military objectives during military operations. It is the purest expression of the foundational balance between humanitarian considerations and military necessity that has underpinned international humanitarian law since its inception. This thesis examines the question of what States are legally empowered to do under international law when they seek to protect certain areas of their Exclusive Economic Zone (EEZ). In this context, the regulation of shipping and other human activities under the Law of the Sea Convention and, in particular, the regime for special areas under Article 211(6) of the Convention are addressed. Global and regional instruments containing mechanisms to protect specific areas are discussed and relevant State practice is considered with a view to possible implications on customary international law. Between 2001 and 2002 the Maritime Institute of the Universiteit Gent and the Centre for International Law of the Vrije Universiteit Brussel joined efforts and hosted Emeritus Professor Dermott Devine as holder of the International Francqui Chair, around the central themes of fisheries and coastal state jurisdiction with respect to marine pollution. As Emeritus Director of the Institute of Marine and Environmental Law, Professor Devine was available for discussion and participation in the scientific life of the different Belgian universities having similar fields of interest. Within this context six classes of excellence were organized with the participation of interested Belgian colleagues across the board, belonging to universities adhering to different basic philosophies and even forming part of different linguistic communities.
