A presente obra analisa a (in)fidelidade partidária, suas causas e consequências. O livro ainda enfrenta o delicado tema ao responder à pergunta sobre a perda do mandato em decorrência da infidelidade partidária, não só dos Deputados Federais, Deputados Estaduais e Vereadores, os quais são eleitos proporcionalmente, mas, também, aos eleitos majoritariamente, quais sejam, o Presidente da República, Senadores, Governadores e Prefeitos. A intensa pesquisa desenvolvida pelos autores mostra a oscilação das decisões do Supremo Tribunal Federal sobre a in(fidelidade) partidária, de modo que, inicialmente, não aceitou a punição através da perda dos mandatos, e, depois, a admitiu com aplicação a todos os ocupantes de cargos eletivos. Ao final, o Supremo Tribunal Federal decidiu que devem ser punidos por infidelidade partidária apenas os eleitos pelo sistema proporcional. Discutiu-se também sobre a legitimidade do Ministério Público para ingressar com ação de perda de mandato em face dos políticos que praticarem a infidelidade partidária. O livro mostra a inconstância do Congresso Nacional sobre o tema em debate, em que, na maior parte das vezes, ameniza as consequências para os infratores. Em conclusão, entendemos que a decisão em punir os eleitos proporcional e majoritariamente por infidelidade partidária, que teve como Relator o Ministro Carlos Ayres Britto, na Consulta no 1407/DF, é mais coerente com o Estado Democrático de Direito e com os princípios constitucionais vigentes. No entanto, prevalece atualmente a decisão em que funcionou como Relator o Ministro Luís Roberto Barroso, na Ação Direta de Inconstitucionalidade no 5.081, de 25 de maio de 2015, que concluiu ser cabível a punição pela perda do mandato em razão da infidelidade partidária apenas para os Deputados Federais, Deputados Estaduais e Vereadores, que são eleitos proporcionalmente, mas não para os eleitos através do sistema majoritário. Por fim, conclui-se que o Ministério Público tem plena legitimidade para a propositura da ação de perda do cargo em decorrência da infidelidade partidária, por ser o defensor do regime democrático, conforme artigo 127 da Constituição Federal.

This collection of essays brings together established scholars of Lusophone Goan literature from India, Brazil, Portugal and Great Britain. For the first time in English, this volume traces the key narrative works, authors and themes of this small but significant territory. Goa, a Portuguese colony between 1510 and 1961, was the site of a particular and particularly intense meeting of West and East. The problematic yet productive encounter between Europe and India that has characterised Goa’s history is a major theme in its literature, which affords important insights and material for post-colonial thought. Goan literature in Portuguese is the only significant Indian literature to have been written in a European language other than English and, as such, provides both a challenging point of comparison with anglophone Indian literature and a space to examine post-colonial theory often implicitly embedded in a British Indian colonial experience.

Language carries more than meanings; language conveys a means of conceiving the world. In this sense, national legal systems expressed through national languages organize the Law based on their own understanding of reality. International Law becomes, in this context, the meeting point where different legal cultures and different views of world intersect. The diversity of languages and legal systems can enrich the possibilities of understanding and developing international law, but it can also represent an instability and unsafety factor to the international scenario. This multilegal-system and multilingual scenario adds to the complexity of international law and poses new challenges. One of them is legal translation, which is a field of knowledge and professional skill that has not been the subject of theoretical thinking on the part of legal scholars. How to negotiate, draft or interpret an international treaty that mirrors what the parties, – who belong to different legal cultures and who, on many occasions, speak different mother tongues – ,want or wanted to say? By analyzing the decision-making process and the legal discourse adopted by the WTO’s Appellate Body, this book highlights the active role of language in diplomatic negotiations and in interpreting international law. In addition, it also shows that the debate on the effectiveness and legitimacy of International Law cannot be separated from the linguistic issue.
