"Le Dictionnaire de droit québécois et canadien regroupe les termes de notre vocabulaire juridique les plus couramment utilisés, le choix des motsà définir et le contenu des définitions se fondant sur une expérience acquise par l'auteur au cours de plus de trente ans d'enseignement et de recherche ainsi que sur une expertise qu'il a développée dans la rédaction de textes législatifs. Seuls des termes ayant un sens juridique certain ont fait l'objet de définitions. La grande majorité d'entre eux est de langue française; on constatera cependant la présence de termes latins ou anglais. Certains mots latins (ainsi que des locutions et des maximes) sont maintenant consacrés par l'usage (ex. ab absurdo, ultra vires) alors que d'autres sont devenus partie intégrante de notre droit à cause de l'influence du droit anglais du temps qu'il était rédigé par des juristes utilisant parfois le latin plutôt que l'anglais (ex. habeas corpus, mandamus). Quant aux termes anglais définis dans le Dictionnaire, il s'agit pour la plupart de mots dont il n'existe pas de pendant en langue française. Il importe également de préciser que les définitions proposées font abstraction des conflits de doctrine et de la contradiction entre certains arrêts de nos tribunaux, l'auteur ayant retenu uniquement le sens qui lui semblait le plus conforme à l'esprit de la loi ou à l'opinion prépondérante. Enfin, même si un dictionnaire n'a pas à exposer, dans les définitions, le régime juridique des notions qui y sont présentées, il peut s'avérer nécessaire de préciser, à l'occasion, le champ d'application d'une définition afin de faciliter la compréhension du lecteur; d'ailleurs, certains dictionnaires juridiques effectuent systématiquement ce travail. On peut toutefois douter de l'utilité de cet exercice de classification puisqu'il est souvent impossible de situer un terme dans une catégorie précise; aussi a-t-il semblé préférable d'offrir au lecteur des exemples ou des notes explicatives qui devraient normalement lui procurer une information satisfaisante. The essays in this volume deal with the legal history of the Province of Quebec, Upper and Lower Canada, and the Province of Canada between the British conquest of 1759 and confederation of the British North America colonies in 1867.
